Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue an appropriate writ order or direction more particularly one in nature of Writ of Mandamus declaring the inaction of the part of respondents, more particularly the Respondent No.5 in executing the quarry lease deed in Form-G as per Letter No.l3/E-Auction-SSS/2026, dated 05.01.2026 for the land in an extent of 4.95 Flectares of YagnesethapalliVilalge, Chilamathur Mandal, Sri Sathya Sai District, without any valid reason whatsoever even though I have made all the necessary payments as per Rule 12 of the Andhra Pradesh Minor Mineral Rules, 1966 and submitted all the necessary documents, as arbitrary, illegal, colorable exercise of power and abdication of statutory duty apart from the violative of the Fundamental and Constitutional Rights guaranteed under Articles 14, 19, 21 and 300-A of the Constitution of India and consequently direct the respondent No.5 to execute a deed in Form-G as per Letter No.l3/E-AuctionSSS/2026, dated 05.01.2026 for the land in an extent of 4.95 Hectares of YagnesethapalliVilalge, Chilamathur Mandal, Sri Sathya Sai District and pass

This Writ Petition is filed under Article 226 of the Constitution of India

seeking the following main prayer:

“…to issue an appropriate writ order or direction more particularly one in nature of Writ of Mandamus declaring the inaction of the part of respondents, more particularly the Respondent No.5 in executing the quarry lease deed in Form-G as per Letter No.13/E-Auction-SSS/2026, dated 05.01.2026 for the land in an extent of 4.95 Hectares of YagnesethapalliVilalge, Chilamathur Mandal, Sri Sathya Sai District, without any valid reason whatsoever even though I have made all the necessary payments as per Rule 12 of the Andhra Pradesh Minor Mineral Rules, 1966 and submitted all the necessary documents, as arbitrary, illegal, colorable exercise of power and abdication of statutory duty apart from the violative of the Fundamental and Constitutional Rights guaranteed under Articles 14, 19, 21 and 300-A of the Constitution of India and consequently direct the respondent No.5 to execute a deed in Form-G as per Letter No.13/E-Auction- SSS/2026, dated 05.01.2026 for the land in an extent of 4.95 Hectares of YagnesethapalliVilalge, Chilamathur Mandal, Sri Sathya Sai District and pass such other orders…”

When the matter is taken up for hearing, the learned counsel for the petitioner fairly submits that in view of the inadvertent mistakes occurred in the lis, he wanted to withdraw the writ petition, with a liberty to file a fresh writ petition.

Mr. Pativada Rama Krishna, learned Government Pleader, is present and has not disputed the same.

Accordingly, the Writ Petition is dismissed as withdrawn, with a liberty to work out his legal remedies in accordance with law including filing of fresh writ petition.
