Respondent No.2 Petition under Section 480 & 483 of BNSS, 2023 is filed praying that in the circumstances stated in the affidavit filed in support of the Criminal Petition, the High Court may be pleased to release^{thePetitioner/Accusedoh} Bail in connection with Crime No. 154 of 2025 of Ediapadu^{PoliceStation,} Palnadu District. The petition coming on for hearing, upon perusing the^{Petitionandthe} memorandum filed in support thereof and upon hearing the arguments of Sri V SURYA KIRAN KUMAR Advocate for the Petitioner, PUBLIC PROSECUTOR for the Respondent No. 1, the Court made the following.

The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused on bail in Crime No. 154 of 2025 of Ediapadu Police Station, Palnadu District, registered against the Petitioner/Accused herein for the offence punishable under Sections 132, 74, 75(1), 76, 64(1) read with 62 of Bharatiya Nyaya Sanhita, 2023.

Heard Mr. V. Surya Kiran Kumar, the learned Counsel for the Petitioner and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor.

The case of the prosecution in brief is that on 09.10.2025 at about 12.50 noon, while the defacto complainant attending her regular duties as Veterinary Assistant the Accused informed that their calf was unwell. The complainant attended the cattle shed to administer medicine to the calf. At about 12.50 p.m the accused again called her to room near his cattle shed stating that the cattle feed need to be examined. When she entered the room, the accused suddenly caught hold of her hands and pressed her private parts forcibly. Basing on the complaint, the instant Crime came to be registered.

Learned counsel for the Petitioner would submit that the Petitioner was arrested on 09.10.2025 and he has been in judicial custody since then. The Petitioner is a permanent resident of Karochola Village, Ediapadu Mandal,

Palnadu District. If he enlarged on bail with certain stringent conditions, he may not interfere with further progress of investigation or hampering the investigation. So far, five witnesses were examined. Investigation is completed and Charge Sheet also filed on 24.10.2025 itself. The Petitioner is suffering with cardiac issues. The Petitioner is ready to furnish^{sufficientsuretiestothe} satisfaction of learned Trial Court to assure his presence for the purpose of trial.

Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor^would submit that investigation is completed in this matter and this Court may pass orders.

Since this is not the case of culpable facts of the case by accepting the allegations, but the Police after due investigation filed Charge Sheet against the Petitioner. The purpose of keeping the Petitioner in jail was already served and filed Charge Sheet. Considering the nature and gravity of allegation levelled against the Petitioner, his alleged role played in this case, and the period of detention undergone by the Petitioner, this Court is inclined to enlarge the Petitioner on bail with the following stringent^conditions:

In the result, the Criminal Petition is allowed with the following conditions:

I. The Petitioner/Accused shall be enlarged on bail subject^to his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) each with two sureties each for^the like

sum each to the satisfaction of the learned Additional Civil Judge (Junior Division), Chilakaluripet.

IIThe Petitioner/Accused shall appear before the Station House Officer, Ediapadu Police Station, Palnadu District, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court, iii. The Petitioner/Accused shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned.

IV. The Petitioner/Accused shall not commit or indulge in commission of any offence in future. V. The Petitioner/Accused shall cooperate with the investigating officer in further investigation of the case and shall make himself available for interrogation by the investigating officer as and when required.

Vi. The Petitioner/Accused shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police^officer, vii. The Petitioner/Accused shall surrender his passport, if any, to the investigating officer. If he claims that he do not have passport, he shall submit an affidavit to that effect to the Investigating Officer.

Accordingly, the Criminal Petition is allowed.
