Andhra Pradesh High Court at Amaravati (Special Original Jurisdiction), single Judge B.V.L.N. Chakravarthi - Writ Petition No.9115 of 2019, decided 03.12.2025. Four petitioners (Hiramiya Chinthakayala, Shaik Khadar Basha, Shaik Ruksana and Shaik Basheer) filed the writ petition under Article 226 of the Constitution seeking a mandamus declaring illegal, arbitrary and violative of Articles 14 and 21 the action of the Station House Officer, Proddatur II Town Police Station (2nd respondent) in proceeding with FIR No.124/2019 (offence under Section 498-A IPC) without following the procedure under Section 41-A CrPC and the procedure laid down by the Apex Court in Arnesh Kumar's case, and directing the 2nd respondent to follow that procedure. The learned Assistant Government Pleader for Home (Sri R. Mallikarjuna Rao), on written instructions, submitted that the 2nd respondent had followed the Apex Court guidelines and issued notice under Section 41-A CrPC, and that investigation in Crime No.124 of 2019 was being conducted in accordance with law. The Court held that, since the police had already issued the Section 41-A notice following due procedure established by law and were conducting the investigation in accordance with law, no further orders were required in the writ petition. The writ petition was accordingly closed, with no order as to costs; pending interlocutory applications, if any, shall stand closed.
