The petitioner, Veeramreddy Saraswathi, had sought a writ of mandamus under Article 226 declaring illegal, arbitrary and without jurisdiction (violative of Articles 14 and 21) the action of respondent Nos. 4 and 5 (Deputy Superintendent of Police, Proddatur, and Station House Officer, Proddatur Rural Police Station) in interfering with a civil dispute over Ac.4.02 cents in Survey Nos. 207/1 and 207/2 of Rameswaram Village Fields, Somulavaripalle Panchayat, Proddatur Mandal, YSR (Kadapa) District, and threatening withdrawal of O.S.No.116 of 2014 pending before the Senior Civil Judge, Proddatur. At hearing, Sri V.Farooq, learned Assistant Government Pleader for Home, submitted that in light of this Court's interim Order dated 16.02.2021 the respondent police were not interfering in the civil disputes between the petitioner and the unofficial respondent (Chintakunta Cheran Teja Naidu). ORDER:

This Writ Petition is filed under Article 226 of Constitution of India with

the following prayer for:

“…to issue a Writ, order or direction more particularly one in the nature of Mandamus declaring the action of the respondents more particularly respondent No.4 and 5 in interfering with the matters of civil disputes pertains to the land admeasuring Ac.2.20 cents in Survey No.207/1 and Ac.1.82 cents in Survey No.207/2 of Rameswaram Village Fields, Somulavaripalle Panchayat, Proddatur Mandal, YSR (Kadapa) District, totally an extent of Ac.4.02 cents and threatening to withdraw the civil suit vide O.S.No.116 of 2014 on the file of Hon'ble Senior Civil Judge, Proddatur as illegal, arbitrary without jurisdiction and also violating Article 14, 21 of the Constitution of India and consequently direct the official respondents not to interfere in civil dispute pertains to land admeasuring Ac.2.20 cents in Survey No.207/1 and Ac.1.82 cents in Survey No.207/2 of Rameswaram Village Fields, Somulavaripalle Panchayat, Proddatur Mandal, YSR (Kadapa) District, totally an extent of Ac.4.02 cents and pass…”

When the matter is taken up for hearing, Sri V.Farooq, learned Assistant Government Pleader for Home would submit that in the light of the interim Order passed by this Court vide Order dated 16.02.2021, the respondent police are not interfering in the civil disputes between the petitioner and unofficial respondent.

Sri Shaik Mohammed Ismail, learned counsel for the petitioner would submit that recording the same, the petition may be disposed of.

In that view of the matter, this Writ Petition is disposed of making the

interim Order as absolute. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand

closed.
