The present Writ Petition is filed questioning the Order dated 21.07.2025, vide Rc.No.2240/DCHS/GND/2025, refusing to extend with Covid weightage marks to the Petitioner to consider the Petitioner’s application for the post of Lab Technicial on contract service though the Petitioner had worked in the post of Lab Technician from 15.12.2016 to 31.08.2021 at Urban Primary Health Centre, Madhuranagar, Vijayawada, as illegal and arbitrary.

The Respondent Authorities had issued G.O.RT.No.211, HM & FW (B2) Department, dated 08.05.2021, for selection and for filling entry-level vacancies under the control of DME, DPH & FW, and the Commissioner of APVVP and accorded the weightage for recruitment of CAS, DAS, Staff Nurses, Lab Technicians, and Pharmacists, among others, who were appointed on a contract/outsourcing basis through the District Selection Committee or an appropriate selection process. As the Petitioner had worked as Lab Technician in the above-

mentioned health center from 15.12.2016 to 31.08.2021, the Petitioner sought consideration of her case for recruitment for the post referred to in G.O.Rt.No.211, dated 08.05.2011, by giving weightage to the services rendered during the Covid2019 period on a contract/outsourcing/honorarium basis.

The Petitioner intially filed W.P.No.9377 of 2025 seeking consideration of her case for appointment to the above mentioned post and this Court vide Order dated 29.04.2025 directed the Respondent therein to consider the case of the Petitioner for the purpose of recruitment to the post mentioned in G.O.Rt.No.211, dated 08.05.2011, taking note of the services of the Petitioner during Covid-19 period. Pursuant thereto, the impugned Order was passed by the Respondent No. 4 on the ground that the Petitioner did not provide any appointment order issued by the competent authority during the period she had worked as referred above. Hence, the Writ Petition.

Learned Assistant Government Pleader submits that though the Petitioner had worked as Lab Technician at Urban Primary Health Centre, Madhuranagar, Vijayawada from

15.12.2016 to 31.08.2021, the case of the Petitioner was not

considered as there was no appointment order supporting her services for the said period.

Heard the respective counsel.

In the Counter Affidavit filed in W.P. No. 9377 of 2025 by the Respondents, the Respondent Authorities admitted to the fact that the Certificate issued by the District Medical and Health Officer, Machilipatnam, Krishna District, stating that the Petitioner had worked from 15.12.2016 to 31.08.2021 in A.E.U.P.H.C. as genuine. It is matter of prudence that the Petitioner could have been permitted to work in a Government hospital without any orders of appointment and the inability of the Petitioner to produce the same cannot be a ground to deny weightage for service in Covid period.

As the services of the Petitioner is found to be genuine, the Respondent Authorities are bound to give weightage while considering the case of the Petitioner for appointment to the post mentioned in G.O.Rt.No.211, dated 08.05.2011.

8. Therefore, the Writ Petition is disposed of with following

i) The impugned Order dated 21.07.2025 issued by the Respondent No.4 is set aside;

ii) The Respondent Authorities are directed to give weightage to the Petitioner while considering the case of the Petitioner for appointment to the post of Lab Technican as mentioned in G.O.Rt.No.211, dated 08.05.2011.

iii) There shall be no order as to costs.

As a sequel, miscellaneous petitions, pending if any, shall stand closed.
