Heard Smt. Y.Maha Lakshmi, learned counsel for the petitioner and Sri Ramesh, learned Assistant Government Pleader for Revenue for respondents 1 to 4.

The grievance of the petitioner is that the 4^th respondent is interfering with the possession of land of an extent of Ac.3.04 cents in Sy.No.2079/3 of Kothuru Village, SPSR Nellore District, without issuing any notice, as illegal and arbitrary.

Learned counsel for the petitioner would submit that an extent of Ac.3.04 cents in Sy.No.2079/3 of Kothuru Village, SPSR Nellore District was assigned to the petitioner’s grandfather in the year 1933. The petitioner, being a lineal descendant, has been in possession and enjoyment of the property. The 4^th respondent, without issuing any notice, is trying to interfere with the petitioner’s possession. Learned counsel would also submit that the name of the petitioner has been updated in the record of rights. Copies of Adangals are filed as Ex.P1 and Ex.P2.

Learned Assistant Government Pleader for Revenue, on instructions, would submit that the 4^th respondent is not interfering with the petitioner’s possession of the property.

Given the facts and circumstances, the writ petition is disposed of, at the admission stage, with the consent of both the learned counsel, directing the 4^th respondent not to interfere with the petitioner’s possession of the property from an extent of Ac.3.04 cents in Sy.No.2079/3 of Kothuru Village, SPSR Nellore District, without following due process. No order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
