ORDER:-

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief;

… to issue an appropriate Writ order or orders more particularly one in the nature of WRIT OF MANDAMUS declaring the inaction of the respondents more particularly respondent No. 3 and 4 in respect of his complaint dated 28.01.2024 against the unofficial respondents who is trespassing and threatening with my peaceful possession and enjoyment of subject land and also trying to damage the property where he got the same by way of regd. Vide Doc.No.2627/2022 on 27.05.2022 even after receipt of the same the 3th and 4^th respondents were not acted against the unlawful activities and trespass by the unofficial respondents which is highly illegal arbitrary and violation of Articles 14, 21 and 300 A of the Constitution of India and consequently direct the respondent no. 4 to act upon my complaint and to take action against the unofficial respondents for their illegal activities and pass… ”

Case of the petitioner is that he purchased the land to an extent of 176 square yards in Sy.No.19 situated at Bheemunipatnam vide document No.2627 of 2022 on 27.5.2022. Since then the petitioner is in peaceful possession and enjoyment of the said property. Thereafter the petitioner came to know that the unofficial respondents got filed a suit in O.S.No.376 of 2023 against him and his vendor seeking partition including his property. The unofficial respondents are trying to trespass into his land and threatened him with dire consequences. On that he submitted representation on 28.1.2024 to the official respondents to take action against the unofficial respondents. But the respondents did not pass any orders on the said representation. Hence the Writ Petition.

On perusal of record, though the representation was submitted by the petitioner on 28.1.2024, till today, the respondent/police have not passed any orders.

In view of the facts and circumstances of the case, the respondent/police are directed to pass orders in accordance with law on the representation dated 28.1.2024 submitted by the petitioner within a period of two (2) weeks from the date of receipt of this order.

With the above direction, the Writ Petition is

disposed of. No costs.

¶28

Miscellaneous petitions, if any pending, in the Writ Petition, shall stand closed.
