The present Writ Petition came to be filed under Article^226of

the Constitution of India seeking the following relief

“...to issue an appropriate Writ, Order or Direction,^{moreinthenatureof} Writ of Mandamus declaring the action of the 2"'^ respondent^Universityin setting a question paper for Physiology - Paper-I and^{II forMDBS} year examination, containing questions which are out of^{syllabusandwhich} carry 18 marks as illegal, arbitrary and violative of Article 14 of Constitution of India and set aside the same and pass ”

Today when the matter is taken up for hearing, learned Standing Counsel, on oral instructions, has stated^{thatthequestion} paper was set from the syllabus and pending the writ^petition,the year examinations were conducted and thereafter, the year MBBS examination results were also announced on 21.01.2017.

In view of the same, this Court is of the opinion that^thecause does not survive anymore.

Accordingly, the Writ Petition is closed. There shall^benoorder as to costs.

As a sequel, miscellaneous applications pending,' if^any, shall also stand closed.
