ORDER:-
This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief;
“…to issue appropriate writ, order or direction especially one in the nature of a Writ of Mandamus declaring the action of the 2nd Respondent in not providing protection for erection of Ground Based Tower (GBT) in the land Plot No. 30 RHR Town ship, Sy.No.506/1, Tenali Village and Mandal, Guntur District as illegal arbitrary and in violation of Articles 19 and 21 of Constitution of India and consequently direct Respondent no.2 to provide Police protection for erection and operation of Ground Based Tower (GBT) in the land Plot No. 30, RHR Town ship, Sy No 506/1, Tenali Village and Mandal Guntur District and pass such…”
was made before the respondent No.3 on 03.11.2023, seeking permission for erection of Ground Based Tower (GBT) in the land bearing No.30, RHR Town Ship in Sy.No.506/1 situated in Tenali Village and Mandal, Guntur District and the respondent No.3 accorded permission on 11.12.2023. When the representatives of the petitioner

company started construction of Ground Based Tower (GBT), the locality people resisted them from proceeding with the erection of towers stating that the radiation which would be emanated from the tower would be dangerous to nearby local people. On that the petitioner made a representation to the respondent No.2 on 23.1.2024 seeking police protection. But the respondents did not pass any orders on the said representation. Hence the Writ Petition.
the respondent/police are directed to pass orders in accordance with law on the representation dated 23.1.2024 submitted by the petitioner within a period of four (4) weeks from the date of receipt of this order.
Miscellaneous petitions, if any pending, in the Writ Petition, shall stand closed.
