Pharmacy 1st year 1st semester examinations scheduled from 18.01.2018 in spite of the ratification/approval orders, dt.02.01.2018 issued by the 2nd respondent A.P State Council of Higher Education as illegal, arbitrary and unconstitutional and consequently direct the 3rd respondent to permit the students of the petitioner college (shown in Annexure - A) to appear for the B. Pharmacy 1st year 1st semester examinations scheduled from 18.01.2018 or any other subsequent date, allow the students (shown in Annexure A) to pursue their further B. Pharmacy Course.

This Writ Petition is filed under Article 226 of the

Constitution of India seeking the following relief:

....to issue a direction or order or Writ more particularly one in the nature of Writ of Mandamus, declaring the action^of the 3''d respondent in not permitting the students of the petitioner college (shown in Annexure-A) to appear for the B. Pharmacy 1 St year ls‘ semester examinations scheduled from 18.01.2018 in spite of the ratification/approval orders dt.02.01. 2018 issued by the 2"^ respondent A.P.State^Councilof Higher Education as illegal, arbitrary and unconstitutional^and consequently direct the S-'d respondent to permit the^studentsof the petitioner college (shown in Annexure-A) to appear^for the B.Pharmacy 1»‘ year 1®^ semester examinations scheduled from 18.01.2018 or any other subsequent date allow the students shown in Annexure A to pursue their further B Pharmacy Course....

When the matter is taken up today, there is no representation on behalf of the petitioner.

At the stage of admission on 25.04.2018, this court passed the following interim order:-

“ Having regard to the facts and submissions, there shall be a direction to the S’-d respondent to declare^the results-of the students of the petitioner, as sought for in the petition, pending further orders in the Writ Petition. This order shall not inure for the benefit of the petitioner^orthe students for claiming equities... ”

When the matter is taken up today, learned Government Pleader for Higher Education submits that in

pursuance of the interim order granted by this Court, the cause in the Writ Petition does not survive and the matter has become infructuous.

Considering the same, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
