“For the reasons stated in the accompanying affidavit, pending disposal of the Writ Petition, it is prayed that this Honourable Court may be pleased to permit the Petitioner to amend the main prayer in the above in the above circumstances, it is prayed that this Honlale Court may be pleased to issue an appropriate writ more in the nature of Writ of Mandamus declaring the action of the Respondent No.2 in issuing the proceedings vide Rc.No.04003/C4/Acad/1989-90, dated 15.08.202, insisting to pay penalty to a tune of Rs.2,00,000/- without there being any fault on the side of the Petitioner institutional against to the AP Education Act 1982 or AP Board of Intermediate Act and Rules framed there under as being arbitrary, illegal and violative of Articles 19 of the Constitution of India besides being in contravention of the Right to Education Act and consequently direct the Respondents to accord permission to the Petitioner Institution to start the Intermediate courses from the academic year 2023-24 and issue such other writ or order or direction as deemed fit and proper in the circumstances of case in the Writ Petition, pending disposal of the Writ Petition, in the interest of justice and pass such order or orders as deemed fit and proper in the circumstances of the case.”
