This Writ Petition is filed questioning the inaction of the official respondents in issuing pattadar passbooks and title deeds to the petitioners in respect of the land admeasuring an extent of Ac.5.00 cents each in Sy.No.12 of Chennakesavapuram Village, Kanigiri Mandal, Prakasam District, pursuant to the assignment granted by the 1^st respondent vide proceedings dated 04.12.2007, as illegal and arbitrary.

The case of the petitioners is that they are working in Army and they submitted an application for grant of assignment of agricultural land and the 1^st respondent assigned the subject land in their favour, vide proceedings dated 04.12.2007 and delivered possession of the same; subsequent to the assignment, the petitioners requested for issuance of pattadar passbooks and title deeds in their favour; as the same were not issued, the present writ petition is filed.

There is no interim direction in the present writ petition.

Learned Government Pleader has passed on written instructions of the Tahsildar, dated 24.12.2021, along with a copy of 1-B Register given to the petitioners for an extent of Ac.2.00 cents each.

As seen from the written instructions of the Tahsildar, only Ac.2.00 cents of land has been assigned to each of the

petitioners in Sy.No.12/12 and 12/14 of Chennakesavapuram Village, Kanigiri Mandal, Prakasam District respectively, vide F.Dis.No.111/1424 and F.Dis.No.112/1424 and that pattadar passbooks were also granted to the petitioners vide Khata No.107 and 108 respectively.

Learned counsel for the petitioners relies upon the proceedings of the Tahsildar, dated 04.12.2007, and submits that the petitioners were infact granted an extent of Ac.5.00 cents of land and not Ac.2.00 cents each.

As seen from the copy of 1-B Register, which is filed along with the written instructions, they were issued pattadar passbooks, subsequent to filing of the writ petition. The written instructions does not deal with the letter of the Tahsildar, dated 04.12.2007.

As no counter affidavit is filed by the respondents, it is not known, as to what transpired after the letter of the Tahsildar dated 04.12.2007.

In view of the facts and circumstances of the case, as the 1-B Register discloses the names of the petitioners to an extent of Ac.2.00 cents of land and as the written instructions show that pattadar passbooks were also issued to the petitioners to the said extent of land, it is open to the petitioners to make a fresh application, if they are so entitled to, for an extent of Ac.5.00 cents each. If such application is filed, the official respondents are directed to deal with the same in accordance with law.

Accordingly, the writ petition is disposed of. There shall

be no order as to costs.

As a sequel, miscellaneous petitions pending, if any,
