they have not conducted any quarry operation in the area either legally or illegally. The petitioner has leveled the land and filled the existing pits with the earth removed from the same land. Hence no irregularities committed by the petitioner, apart from the same, the petitioner has also relied on the G.O.Ms.No.139, dated 12.11.2013, wherein the Government exempts the seigniorage fee for leveling of land for agriculture purpose. Considering the said G.O, various Writ Petitions were disposed of by this Court and same is reported in 2013(4) ALD 490. In spite of above ruling of this Court and instructions of the Government without considering the same the Government authorities have issued impugned notice, questioning the same the petitioner has filed W.P.No.39763 of 2015 and the same was allowed and remanded back to the Assistant Director of Mines and Geology to consider the explanation submitted by the petitioner. Pursuant to the orders passed by this Court in the said Writ Petition the authorities have issued notices once again on 07.09.2017 and the petitioner has submitted his explanation without considering the same the against impugned demand notice was issued on 10.11.2020 without mentioning any reasons. Assailing the arbitrary action of the respondents the petitioner has preferred a Revision before the 1st respondent on 24.11.2020 along with stay petition by raising all grounds and submitted a copy of the G.O.Ms.No.139, dated 12.11.2013. Despite, the respondent authorities did not consider the Revision and stay petition, when the Revision and stay petition is pending before the 1st respondent, the 3rd respondent is proceeding to recover the amounts as per the Demand Notice dated 10.11.2020. Hence the Writ Petition is filed.
