ORDER:
The Writ Petition is filed under Article 226 of the Constitution of India seeking to declare the action of the 2nd respondent in not deciding the appeal representation dated 07.4.2014 filed by the petitioner challenging the order of the 3rd respondent dated 05.4.2014 in R.C.No.202/2012/A1 in suspending his A4 license being run in the name of M/s. Wine Corner as arbitrary, illegal, and consequently direct the 2nd respondent to dispose of the petitioner’s appeal representation dated 07.4.2014 forthwith.
During the course of hearing, the learned Counsel for the petitioner and learned Government Pleader for Excise submit that the matter pertains Form-A4 license and in view of the changed policy, nothing survives in the matter and no further orders are required and the same became infructuous.
Accordingly, the writ petition is dismissed as infructuous. No costs.
As a sequel, all the pending miscellaneous applications, if any, shall stand closed.
