ORDER:-
This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for short “Cr.P.C.”) is filed against the order dated 23.06.2021 in Criminal Revision Petition No.20 of 2020 on the file of the learned XI Additional District and Sessions Judge, Gudivada, whereby the learned Sessions Judge dismissed the revision petition confirming the order of the learned Magistrate.
While allowing the petition filed under Section 451 Cr.P.C for release of vehicle towards interim custody, the Courts below have imposed a condition to furnish Bank guarantee for a sum of Rs.4,00,000/-.
Aggrieved by the said condition imposed for release of the vehicle towards interim custody to furnish Bank guarantee for Rs.4,00,000/-, the petitioner has filed this Criminal Petition under Section 482 Cr.P.C seeking relaxation of the said condition.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Having regard to the facts and circumstances of the case, the Criminal Petition is allowed modifying the aforesaid condition to furnish Bank guarantee for a sum of Rs.4,00,000/- for release of the vehicle towards interim custody. The petitioner is permitted to

furnish third party security for a sum of Rs.4,00,000/- for release of the said vehicle towards interim custody to the petitioner.
Miscellaneous petitions, if any pending, in the Criminal
Petition, shall stand closed.
