ORDER:

This Writ Petition is filed seeking the following relief:

“…declaring that (a) the list of directors placed by the Ministry of Corporate Affairs MCA on the website i.e., www.mca.gov in as arbitrary illegal without jurisdiction contrary of the provisions of the Companies Act, 2013 and Rule 11 of the Companies Appointment of Directors Rules, 2014 violative of the principles of natural justice besides violating the Petitioner’s rights guaranteed under Article 14 and Article 19(1)(g) of the Constitution of India and quash/set aside the same to the extent it declares/treats the Petitioners as disqualified in terms of Section 164(2)(a) of the Companies Act, 2013 in the interest of justice (b) that the Petitioner is not disqualified in terms of Section 164(2)(a) of the Companies Act, 2013 for the reason of alleged default of non-filing financial statements/Annual Returns, writ of mandamus or any other appropriate writ order or directing the Respondent Nos.1 and 2 to restore the DIN numbers of Petitioner i.e., Venkata Krishna Kishore Reddy DIN: 02467991, and to permit the Petitioner to file/submit forms/e-forms pertaining to pending financial statements and/or annual returns of the companies and pass such other order …”

When the matter came up for hearing, learned counsel for the petitioner as well as Sri N.Harinath, learned Assistant Solicitor General of India appearing for the respondents, submit

that in similar facts and circumstances, the High Court of Judicature for the State of Telangana and the State of Andhra Pradesh disposed of a batch of Writ Petitions in W.P.No.17409 of 2018 and batch.

In view of the same and following the order dated 11.10.2018 passed in W.P.No.17409 of 2018 and batch, this Writ Petition is also disposed of, directing the respondents to restore the Director’s Identification Number of the petitioner, if the companies in which he is disqualified are registered within the State of Andhra Pradesh, so as to enable him to submit annual returns and financial statements of the active companies in which he is Director. It is also made clear that this order holds good only for active companies. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
