This writ petition is filed for the following relief:

‘……to declare the action of the respondents in not promoting the petitioner as Executive Engineer, Panchayat Raj against the existing vacancies as mentioned by the 2^nd respondent in Lr.No.G.Section/10766/2014, dated 24.10.2019 for the panel year 2018-2019 in pursuance of G.O.Ms.No.70, Panchayat Raj & Rural Development(E.I) Department, dated 07.03.2019, as arbitrary and illegal’.

The case of the petitioner is that, he got promotion as Deputy Executive Engineer in the year 1998; the respondents prepared the panel of Deputy Executive Engineers for promotion to the post of Executive Engineer(Panchayath Raj) for the panel year 2018-2019, i.e. reckoning the eligibility date as 1^st September, 2018 and the said panel will exist till end of December, 2019; as per G.O.Ms.No.70, Panchayat Raj & Rural Development Department, dated 07.03.2019, the panel of the respondents considered 53 Deputy Executive Engineers, who are in the Zone of consideration; the Departmental Promotion Committee approved 46 Deputy Executive Engineer cases for promotion to the post of Executive Engineer for the panel year 2018-2019 and the petitioner was figured at Sl.No.45; the 1^st respondent promoted as many as (41) Deputy Executive Engineers as Executive Engineers, Panchayat Raj; the last candidate who got promotion as Executive Engineer is A.Venkata Prasad as per G.O.Ms.No.139, Panchayat Raj & Rural Development Department, dated 31.08.2019 whose name figured at Sl.No.44, whereas the petitioner name figured at

Sl.No.45; admittedly as of now (2) Executive Engineer posts are vacant in the department at Kadapa and Visakhapatnam prior to 31.08.2019; the respondents ought to have promoted the petitioner as Executive Engineer as his name already approved and vacancies are very much available; the 2^nd respondent also addressed a letter, dated 24.10.2019 to the 1^st respondent, sending proposal to fill up (2) posts of Executive Engineer, Panchayatraj in P.R.E.D., as well as (9) posts on deputation basis in (5) departments; petitioner also made a representation on 24.10.2019 to R1 to consider his case for promotion, but no action has been taken. Hence, the Writ Petition.

Learned Government Pleader for Panchayathraj, appearing for the respondents submits that appropriate action would be taken on the representation of the petitioner, dated 24.10.2019.

In view of the facts and circumstances of the case, without going into the merits of the case, the respondents are directed to dispose of the representation, dated 24.10.2019 of the petitioner, strictly in accordance with law, as expeditiously as possible, preferably within a period of eight(8) weeks from the date of receipt of a copy of this order.

Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
