Heard Shri Ravindra Kumar Ravi, the learned counsel for the petitioner, Shri Vishal Tehlani, the learned Standing Counsel for the State representing the respondent Nos.1 and 2 and Shri am Milan Yadav, the learned counsel for the respondent No.4.

By means of the instant petition filed under Article 226 of the Constitution of India, the petitioner has sought issuance of a direction for disposal of the petitioner's application dated 19.07.2025 praying for demarcation for land bearing Gata No.251 situated in Village- Naugawan and to remove encroachment made on the said land.

The learned counsel for the petitioner has submitted that the aforesaid land is recorded as a pond regarding which a fishery lease deed has been executed in favour of the petitioner.

On the basis of written instructions, the learned Standing Counsel has submitted that an order for demarcation of the land was passed on the petitioner's application on 29.10.2024. The respondent No.4 has filed an Appeal against the aforesaid order before the Chief Revenue Officer and the next date fixed before

the Appellate Authority is 06.02.2026.

Learned Standing Counsel has submitted that any further action can be taken by the authorities only after disposal of the appeal.

The present petition is disposed off by providing that Appeal No.C2024000003006 pending before the Chief Revenue Officer concerned, which is fixed on 06.02.2026, shall be decided expeditiously, in accordance with law, after giving a reasonable opportunity of hearing to the parties concerned.
