पुकार पर यािचका पर बल देने के िलए कोई उपिस्थित नहीं है एवं सुनवाई स्थगन हेतु कोई अनुरोध भी नहीं िकया गया है। यह यािचका िदनांक 16.12.2025 को प्रस्तुत की गई थी तथा पूवर् में यह 12 ितिथयों को सूचीबद्ध हो चुकी है। िदनांक 09.1.2026 को जब यािचका पर बल देने के िलए कोई उपिस्थित नहीं हुआ था तो न्यायालय ने प्रकरण की सुनवाई स्थिगत करते हुए यह आदेश िदया था िक अगली सुनवाई पर कोई यािचका पर बल देने को उपिस्थत नहीं होता है तो न्यायालय यािचका में उिचत आदेश पािरत कर देगी। अतः न्यायालय यािचका के गुण-दोष का परीक्षण करने को अग्रसर होती है।

भारतीय संिवधान के अनुच्छेद 227 के अन्तगर्त प्रस्तुत इस यािचका द्वारा यािचकाकतीर् ने िवपक्षीगण को िववािदत सम्पित्त की सवेर् की प्रिक्रया अपनाने तथा िसिवल जज (अवर खंड), मुसािफरखाना को मूल वाद संख्या 18/2016 की कायर्वाही शीघ्रतापूवर्क िनष्पािदत करने का िनदेर्श देने का अनुरोध िकया है।

यािचका में िसिवल जज को िवपक्षी बना िदया गया है, जब िक जोगेंद्रिसहजी िवजयिसहजी बनाम गुजरात राज्य (2015) 9 एससीसी 1 तथा सािवत्री देवी बनाम िजला न्यायाधीश, गोरखपुर (1999) 2 एससीसी 577 के िनणर्यों में माननीय उच्चतम न्यायालय ने यािचकाओं में न्यायालयों को िवपक्षी के रूप में पक्षकार बनाने की प्रथा की भत्सर्ना की थी तथा जोगेंद्रिसहजी िवजयिसहजी के िनणर्य में माननीय उच्चतम न्यायालय ने यह स्पष्ट िकया है िक जो न्यायालय / न्यायािधकरण अपने आदेशों का बचाव करने के िलए इस न्यायालय के समक्ष उपिस्थत नहीं होंगे उन्हें यािचकाओं में िवपक्षी नहीं बनाना चािहए तथा इस यािचका में पक्षकारों के कुसंयोजन का दोष भी है।

उपरोक्त मूल वाद में यािचकाकतीर् एवं छः अन्य व्यिक्तयों के िवरुद्ध स्थायी व्यादेश के अनुतोष हेतु प्रस्तुत िकया था, िकन्तु वाद के अन्य प्रितवादीगण को यािचका में पक्षकार नहीं बनाया गया है, जब िक जहां प्रिक्रया िकसी वाद से प्रारंभ हो रही हो तो वाद के सभी पक्षकार यािचका में आवश्यक पक्षकार होते हैं।

यािचकाकतीर् वाद में प्रितवादी संख्या 1 है उसने अपना प्रितवाद पत्र वषर् 2017 में ही प्रस्तुत कर िदया था, िजसमें यािचकाकतीर् ने कहा िक पक्षों के मध्य बटवारा हो चुका है। बटवारे के अनुसार सभी पक्ष अपने-अपने अंश पर कािबज़ हैं एवं बटवारा पक्षों पर बाध्यकारी है।

यािचका में ऐसा कोई कथन नहीं है, िजससे यह प्रतीत हो िक िववािदत सम्पित्त का सवेर् कराने हेतु यािचकाकतीर् ने कोई प्राथर्ना पत्र िदया एवं वह प्राथर्ना पत्र िनरस्त हुआ। इस कारण से इस यािचका में िववािदत सम्पित्त के सवेर् का िनदेर्श देने हेतु कोई उिचत आधार नहीं है, जबिक वाद एक ही पिरवार के सदस्यों के बीच है तथा यह वषर् 2016 से लिम्बत है, वाद का शीघ्र िनस्तारण न्यायिहत में उिचत प्रतीत होता है।

ऐसी पिरिस्थित में यािचका इस िनदेर्श के साथ िनस्तािरत की जाती है िक िसिवल जज (अवर खंड), मुसािफरखाना, जनपद अमेठी, मूल वाद संख्या 18/2016 (भगौट्टी बनाम िनमर्ला देवी और अन्य), CNR संख्या UPST120004232016, का िनस्तारण िबना िकसी पक्ष को अनावश्यक स्थगन देते हुए शीघ्रतापूवर्क िविधनुसार करना सुिनिश्चत करें।
