Heard the learned counsel for the applicant, Sri V. K. Shahi, the learned A.G.A. for the State of U.P. and Sri Ajay Singh Tomar, Inspector, Cyber Crime Police Station Reabareli, District- Raebareli, who is present before the Court today, as well as perused the record.

The present application has been filed on behalf of the applicant seeking anticipatory bail in Case Crime No. 003/2025, under Sections- 318(4), 111(3), 111(4) B.N.S. and Sections- 66C and 66D of Information Technology (Amendment) Act, 2008, Police Station- Cyber Crime, DistrictRaebareli.

For the purposes of entertaining the instant application and also protecting the interest of the applicant, this Court considered the facts of the case including the following, which have been pleaded:

(i) The applicant is Shadab s/o Subrati Lal Mohammad, R/o Onai Pahad Pur, Gurubuxganj, Rae Bareli, Uttar Pradesh-229001 and not Mohd. Shadab.

(ii) The applicant is having Aadhar Card bearing Number as 9516 9235 5557 with the date of birth as 20.04.1994 and with the same address.

(iii) The applicant is having Pan Card bearing Permanent Account Number Card as GVJPS6744D.

(iv) An unknown person presented himself as Mo. Shadab s/o Mo. Subrati, R/o Gram Onai Pahar Pur, Post- Gurubuxganj, Raebareli, Uttar Pradesh- 229001 and got prepared a forged Aadhar Card bearing No. 7638 4547 1386 and also a forged Pan Card having Permanent Account Number Card RWJPS9593G giving date of birth and address of the applicant.

(v) The signatures on both the aforesaid Pan Cards are different.

(vi) Till date the prosecution has not come to the conclusion that as to which Aadhar Card or Pan Card is the forged one and as to who has obtained the forged documents for the purposes of opening the fake accounts and committing cyber crime.

This Court also took note of the statement of Police Officer present before the Court today that the veracity/genuineness of the documents in issue would be verified from the Department concerned.

Upon due consideration of the aforesaid, this Court finds that the applicant is entitled to interim protection.

Accordingly, as an interim measure it is provided that in the event of arrest, the accused-applicant- Shadab be released forthwith in the aforesaid case crime (supra) on anticipatory bail on furnishing a personal of Rs. 25,000/- and two sureties (both of family members) of Rs. 3,00,000/- (Rs. Three Lakhs Only) each in the like amount to the satisfaction of Station House Officer of the Police Station concerned/Court concerned with the following conditions:-

(i) That the accused-applicant shall make himself available for interrogation by police authorities as and when required and will cooperate with the investigation and would appear before the Investigating Officer (in short "I.O.") on 09.03.2026, which has been fixed by this Court with the consent of parties, and also on the subsequent dates fixed by the I.O.;

(ii) That the accused-applicant shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer; and

(iii) That the accused-applicant shall not leave India without the previous permission of the Court.

Let the the informant of the case be informed by the SHO concerned regarding pendency of the instant case and date fixed in it.

Learned AGA is directed to communicate this order to the SHO concerned forthwith and file an affidavit in response to this application annexing therewith the proof of information given by the S.H.O. concerned to the informant when the case is listed next.
