आवेिदका की ओर से धारा 528 भारतीय सुर्षा संिहता के अंतगर्त यह आवेदन प्ऴ , िविवध वाद सं० 231/2015 (बन्नो िनशा बनाम अरसद अहमद व अन्य), अंतगर्त धारा 244 दं०्ऺ०सं० में अपर मुख्य न्याियक मिजस ् ेट-्ऺथम, कानपुर देहात ्षारा पािरत आदेश िद० 21.08.2023 एवं दािण्डक पुनरी्षण सं० 120/2025 (बन्नो िनशा बनाम राज्य) अंतगर्त धारा 438 दं०्ऺ०सं० में स्ऴ न्यायाधीश रमाबाई नगर, कानपुर देहात ्षारा पािरत आदेश िदनांक 28.03.2026 को अपास्त करने हतु योिजत िकया गया है।

आवेिदका के िव्षान अिधव्वा एवं िव्षान अपर शासकीय अिधव्वा को सुना तथा प्ऴावली का पिरशीलन िकया।

आवेिदका के िव्षान अिधव्वा ने तकर् ्ऺस्तुत िकया िक आवेिदका ने िवप्षी संख्या 2 से 4 के िखलाफ िव्षान न्याियक मिजस ् ेट ि्षतीय, कानपुर देहात की अधीनस्थ अदालत में िदनांक 24.03.2015 को दं.्ऺ.सं. की धारा 156(3) के तहत एक आवेदन इस आरोप के साथ दायर िकया था िक िदनांक 25.02.2015 को, जब वह अपने घर पर काम कर रही थी, िवप्षी संख्या 2 से 4 ने जबरन उसके घर में ्ऺवेश िकया और उसके साथ मारपीट की तथा उसके साथ अ्श ील कृत्य िकया। आवेिदका ने अपने मामले के समथर्न में दो गवाहों, अथार्त् हस्बीन िनशा और रहमत अली को ्ऺ स्तुत िकया, िजनकी िव्षान मिजस ् ेट के सम्ष िदनांक 07.10.2015 और 20.10.2015 को परी्षा की गई और दं.्ऺ.सं. की धारा 202 के तहत उनके बयान दजर् िकए गए। िव्षान मिजस ् ेट ने दं.्ऺ.सं. की धारा 156(3) के तहत दायर आवेदन में लगाए गए अिभयोजन के आरोपों और साथ ही दं.्ऺ.सं. की धारा 200 और 202 के तहत दजर् बयानों के आधार पर, आदेश िदनांक 01.12.2015 के माध्यम से िवप्षी संख्या 2 से 4 को आई.पी.सी. की धारा 354, 504 के तहत तलब (समन) िकया। यहाँ यह उल्लेख करना ्ऺासंिगक है िक समिनग आदेश (तलब करने का आदेश) िदनांक 01.12.2015 पािरत होने के बाद िवप्षी संख्या 2 से 4 को नोिटस जारी िकए गए थे, लेिकन वे िदनांक 06.06.2023 तक उपिस्थत नहीं हुए

और िदनांक 06.06.2023 को उन्होंने गैर-जमानती वारंट जारी होने के बाद आत्मसमपर्ण कर िदया और जमानत ्ऺाप्त कर ली। इसके प्ाात मामले को पुनरी्षणकतार् (िरवीजिनस्ट) और अन्य गवाहों के साष्य हेतु िदनांक 12.06.2023 के िलए िनयत िकया गया था। इसके प्ाात अधीनस्थ िव्षान न्यायालय ने दं.्ऺ.सं. की धारा 244 के तहत आवेिदका का बयान दजर् करने के िलए िदनांक 26.07.2023 िनयत की थी, लेिकन िकसी कारणवश उस तारीख को बयान दजर् नहीं िकया जा सका। िव्षान न्यायालय ने दं.्ऺ.सं. की धारा 244 के तहत आवेिदका का बयान दजर् करने के िलए िदनांक 21.08.2023 िनयत की थी, लेिकन उस तारीख को आवेिदका बीमार हो गई, इसिलए उसने स्थगन (स्थगन ्ऺाथर्ना प्ऴ) ्ऺस्तुत िकया, परंतु िव्षान अधीनस्थ न्यायालय ने उसे खािरज कर िदया और दं.्ऺ.सं. की धारा 244 के तहत आवेिदका के साष्य (गवाही) का अवसर बंद कर िदया। िव्षान अधीनस्थ न्यायालय ्षारा पािरत आदेश अवैध, अन्यायपूणर् और कानून की नजर में कायम रहने योग्य नहीं है। आवेिदका ने िदनांक 20.12.2024 को पुनरावलोकन (िरकॉल) आवेदन भी दायर िकया था, लेिकन िव्षान अधीनस्थ न्यायालय ्षारा उसे भी खािरज कर िदया गया था।इसके प्ाात आवेिदका ने िदनांक 27.01.2025 को िजला एवं स्ऴ न्यायाधीश, कानपुर देहात के सम्ष पुनरी्षण (िरवीजन) दायर िकया। पूवर् में िव्षान मिजस ् ेट का न्यायालय िर्व था, इसिलए िरकॉल आवेदन पर सुनवाई नहीं हो सकी और आवेिदका के वकील की अनुपिस्थित में िदनांक 02.09.2024 को इसे खािरज कर िदया गया। आवेिदका ने मामले को शी्सता से आगे ब़ााने में कोई अवैधता या िशिथलता नहीं की, बिल्क ऐसा अपिरहायर् पिरिस्थितयों के कारण हुआ। आवेिदका ने िव्षान िवचारण न्यायालय (्िायल कोटर्) के सम्ष पहले ही स्थगन आवेदन िदया था, लेिकन िव्षान न्यायालय ने इसे अवैध रूप से खािरज कर िदया और दं.्ऺ.सं. की धारा 244 के तहत आवेिदका के साष्य का अवसर बंद कर िदया। इससे िव्षान िवचारण न्यायालय और साथ ही िव्षान पुनरी्षण न्यायालय ने आवेिदका के दं.्ऺ.सं. की धारा 244 के तहत आवेदन तथा आवेिदका ्षारा दायर पुनरी्षण (िरवीजन) को खािरज करके घोर अिनयिमतता की है। आ्षेिपत आदेश पूरी तरह से अवैध, मनमाने और इस माननीय न्यायालय ्ष ारा अपास्त िकए जाने योग्य हैं।

िव्षान अपर शासकीय अिधव्वा ने कथन िकया िक ्ऺश्नगत मामलें में समुिचत िववेचना के उपरांत िवचारण न्यायालय ्षारा पयार्प्त आधार पर ्ऺश्नगत आदेश पािरत िकया है तथा ्ऺश्नगत आदेश के िवरू्ध योिजत पुनरी्षण यािचका भी संबंिधत न्यायालय ्षारा िनरस्त की जा चुकी है। ्ऺ श्नगत आदेश में कोई िविधक अथवा ्षे्ऴ ािधकार संबंधी ्ऴुिट पिरलि्षत नहीं हो रही है तथा ्ऺ श्नगत आदेश को अपास्त करने हेतु जो तकर् ्ऺस्तुत िकए गए वे बलहीन है। इसिलए , ्ऺश्नगत आदेश में हस्त्षेप िकए जाने की कोई आवश्यकता ्ऺतीत नहीं हो रही है।

उभय प्ष के िव्षान अिधव्वागण के तकॏल को ्शवणोपरांत एवं प्ऴावली व ्ऺश्नगत आदेशों का सम्यक रूपेण पिरशीलन िकया तथा िव्षान अवर न्यायालय ्षारा पािरत ्ऺश्नगत आदेश समुिचत िववेचना पर आधािरत है , सकारण एवं उिचत आदेश है। उसमें कोई सारवान अिनयिमतता , अनौिचत्यता या ्ऺि्वया या ्षे्ऴ ािधकार संबंधी ्ऴुिट पिरलि्षत नहीं होती है। इसिलए, यह

कायार्लय को िनदरॏश िदया जाता है िक इस आदेश की एक ्ऺितिलिप संबंिधत अवर न्यायालय को अिवलम्ब भेजना सुिनि्ात िकया जाय।
