आवेिदका की ओर से धारा 528 भारतीय सुर्षा संिहता के अंतगर्त यह आवेदन प्ऴ , मु०अ०सं० 697/2016, अंतगर्त धारा 498ए, 304बी भारतीय दण्ड संिहता व धारा 3/4 दहेज ्ऺ ितषेध अिधिनयम, थाना धूमनगंज, िजला ्ऺयागराज में ्ऺेिषत आरोप प्ऴ 285/2016, िदनांिकत 18.12.2016 को अपास्त करने तथा इससे उ्यूत स्ऴ परी्षण संख्या 50 वषर् 2017 (राज्य बनाम ्शीमती शकुंतला देवी व अन्य), जो अपर स्ऴ न्यायाधीश, एफ.टी.सी.01, इलाहाबाद ्षारा पािरत आदेश िद० 02.01.2017 को अपास्त करने हेतु योिजत िकया गया है।

आवेिदका की ओर से ्ि ि्वगत रूप से उपिस्थत ्शी आशुतोष ि्षवेदी एवं िव्षान अपर शासकीय अिधव्वा को सुना तथा प्ऴावली का पिरशीलन िकया।

आवेिदका के िव्षान अिधव्वा ने तकर् ्ऺस्तुत िकया िक आवेिदका के छोटे भाई ्ऺेम नारायण ि्षवेदी का िववाह सूचनाकतार् की पु्ऴी िनशा के साथ िदनांक 16.02.2016 को संपन्न हुआ था। िववाह के कुछ िदनों प्ाात वह अपने मायके वापस चली गई थी और दूसरी बार आवेदकों के घर (ससुराल) िदनांक 06.10.2016 को आई थी तथा िदनांक 08.10.2016 को शाम लगभग 6:30 बजे सूचनाकतार् की पु्ऴी ने ससुराल के घर की पहली मंिजल पर फांसी लगाकर आत्महत्या का ्ऺयास िकया, िजसके प्ाात मृतक के पित ने अपनी पत्नी (सूचनाकतार् की पु्ऴी

) को भतर् कराने हेतु एस.आर.एन. अस्पताल ले गया, जहाँ राि्ऴ लगभग 9:00 बजे उसकी मृत्यु हो गई। ्ऺ थम सूचना िरपोटर् के अवलोकन से यह स्प्ि रूप से ्ऺ कट होता है िक सूचनाकतार् के पु्ऴ को िकसी अन्य ्ि ि्व का फोन आया था, िजसका अथर् है िक वह ्ि ि्व उ्व घटना का एकमा्ऴ ्ऺत्य्षदशर् था। िकतु, िववेचना अिधकारी जाँच के दौरान इस ्ि ि्व को गवाह के रूप में ्ऺस्तुत करने में िवफल रहे, अतः इस िबदु पर िववािदत आरोप-प्ऴ (charge sheet) ्ऴुिटपूणर् है और िववेचना के दौरान वास्तिवक िस्थित कभी सामने नहीं आ पाएगी। आगे यह भी कहा गया िक मृतका की सी.डी.आर. (कॉल िडटेल िरपोटर्) के अनुसार यह अत्यंत स्प्ि है िक उसकी मृत्यु से पूवर् िदनांक 08.10.2016 को दोपहर लगभग 12:14 बजे और 12:16 बजे उसके मोबाइल नंबर 912086XXXX पर मोबाइल नंबर 911819XXXX से कॉल ्ऺ ाप्त हुई थी, जो िक सूचनाकतार् का था। पुनः शाम 18:02 बजे तथा 18:11 बजे कॉल ्ऺाप्त हुई और लगभग 174 सेकंड तक बातचीत हुई। आवेदक के अनुरोध के बावजूद िववेचना अिधकारी इन िविश्ि साष्यों को एक्ऴ करने में िवफल रहे, जबिक िव्षान िनचली अदालत के िनदरॏश पर आई.ओ. ने मृतका की सी.डी.आर. एक्ऴ की थी। िकतु, िववेचना अिधकारी ने उ्व अपराध केस की िववेचना में इसे शािमल नहीं िकया, जबिक इसके हेतु मा० उच्च न्यायालय ्ष ारा मृतका के पित की जमानत स्वीकार करते जमानत आदेश में इस संबंध में अवलोकन/ पयर्वे्षण िदया था। उपयुर ् तथ्यों से पिरलि्षत है िक इस मामलें में िजस आधार पर पूरी अिभयोजन कहानी िटकी हुई, उन्हीं तथ्यों का िववेचक ्षारा िववेचना में समानेशन नहीं िकया गया। िववेचना अिधकारी की इस ्ऴुिट के कारण अिभयोजन का सही प्ष साष्य के रूप में सामने नहीं आ सका और आवेदक का पिरवार अपनी बहू की हत्या के झूठे आरोपों को झेल रहा है। आगे यह भी कहा गया िक यह स्वीकृत तथ्य है िक मृत्यु िववाह के एक वषर् के भीतर हुई है, परंतु पोस्टमाटर्म िरपोटर् के सूष्म पठन से यह स्प्ि रूप से ्ऺकट होता है िक शरीर पर ्वू रता या शारीिरक उत्पीड़न की कोई चोट नहीं है। अतः इस बात का कोई साष्य नहीं है िक किथत अिभयु्वों ्षारा दहेज की मांग के संबंध में कोई ्वूरता या उत्पीड़न िकया गया था, और न ही इस बात का कोई ्ऺमाण है िक मृत्यु से पूवर् ऐसी कोई ्वूरता की गई थी। अतः वतर्मान मामला स्प्ि रूप से आत्महत्या का है, िजसे सूचनाकतार् ने दहेज मृत्यु का रंग दे िदया है। इसिलए, ्ऺश्नगत आदेश ्ऴुिटपूणर् है एवं अपास्त िकए जाने योग्य है।

िव्षान अपर शासकीय अिधव्वा ने कथन िकया िक ्ऺश्नगत मामलें में समुिचत िववेचना के उपरांत आरोप प्ऴ दािखल िकये जाने के उपरांत संबंिधत िवचारण न्यायालय ्षारा पयार्प्त आधार पर ्ऺश्नगत आदेश पािरत िकया है, िजसमें कोई िविधक अथवा ्षे्ऴ ािधकार संबंधी ्ऴुिट पिरलि्षत नहीं हो रही है। उनका यह भी कथन है िक आवेिदका के िव्षान अिधव्वा ्षारा आरोप प्ऴ एवं ्ऺश्नगत आदेश को अपास्त करने हेतु जो तकर् ्ऺस्तुत िकए गए वे बलहीन है। इसिलए , ्ऺश्नगत आदेश में हस्त्षेप िकए जाने की कोई आवश्यकता ्ऺतीत नहीं हो रही है। 7. उभय प्ष के िव्षान अिधव्वागण के तकॏल को ्श वणोपरांत एवं प्ऴावली व ्ऺश्नगत आदेशों का सम्यक रूपेण पिरशीलन िकया तथा िव्षान अवर न्यायालय ्षारा पािरत ्ऺश्नगत

आदेश समुिचत िववेचना पर आधािरत है , सकारण एवं उिचत आदेश है। उसमें कोई सारवान अिनयिमतता , अनौिचत्यता या ्ऺि्वया या ्षे्ऴ ािधकार संबंधी ्ऴुिट पिरलि्षत नहीं होती है। इसिलए, यह आवेदन प्ऴ को िनरस्त िकए जाने योग्य है।
