आवेदकगण की ओर से धारा 528 भारतीय नागिरक सुरक्षा संिहता के अन्तगर्त यह आवेदन पत्र, पिरवाद सं० 670 , वषर् 2022 ( हेमलता उफर् लक्ष्मी बनाम ओमलर उफर् करुआ व अन्य ) अन्तगर्त धारा 406 भा०दं०िव० में न्याियक मिजस्ट्रेट , फतेहाबाद आगरा द्वारा पािरत सम्मन / तलबी आदेश िदनांक 19.02.2024 एवं इस वाद की संपूणर् कायर्वाही को अपास्त करने हेतु योिजत िकया गया है।

आवेदकगण के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

आवेदकगण के िवद्वान अिधवक्ता का कथन है िक आवेदक सं० 1 , िवपक्षी सं० 2 का पित है तथा अन्य सास-ससुर, देवर-ननद है। िवपक्षी सं० 2 द्वारा दुराशय के तहत वतर्मान योिजत िकया गया है, जबिक प्रश्नगत प्रकरण व्यवहािरक प्रकृित का है। इस प्रकरण में पक्षकारों के मध्य सुलह-समझौता हो जाने की संभावना है। इसिलए, इस प्रकरण को संबंिधत अवर न्यायालय के मध्यस्थता केन्द्र को स्थानान्तिरत कर िदया जाय।
