Anita Mishra, permanent resident of House No.N-1/12-L-8-Ch Nagawa City, District Varanasi, sought a writ of mandamus commanding the respondent authorities to provide her a new electricity connection within a stipulated period. She had applied after obtaining a 'no objection' from her father-in-law, the owner of the house, to which no connection had been given, and complained that the authority was sitting tight over the matter despite repeated requests. After a short counter affidavit of respondent nos.3 to 5 and her rejoinder were taken on record, and with counsel for respondents conceding that no useful purpose would be served in keeping the petition pending, the Court, without going into the merits, disposed of the writ petition, permitting the petitioner to submit a fresh representation before respondent no.3, Executive Engineer (Urban), Vidyut Vitaran Khand-IV, Bhelupur, District Varanasi, with a certified copy of the order within one month, and directing respondent no.3 to consider and decide it by a reasoned and speaking order preferably within one month thereafter.

A short counter affidavit filed on behalf of respondent nos.3 to 5 today in Court is taken on record. A rejoinder affidavit has also been filed today in Court, which is also taken on record.

Heard learned counsel for the petitioner, learned Standing Counsel for respondent nos.1 and Sri Udit Chandra, learned counsel for respondent nos.2 to 5.

The petitioner by means of the present writ petition has prayed for the following relief:

" (i) Issue a writ, order or direction in the nature of mandamus commanding the Respondent Authorities to provide electricity connection within stipulated period to the petitioner.

(iii) Issue any other writ, order or direction which this Hon'ble Court may deem fit and proper under the circumstances of the case.

(iv) Award cost of the petition to the petitioner"

The case of the petitioner is that she is a permanent resident of House No.N-1/12-L-8-Ch Nagawa City, District Varanasi. The petitioner has submitted an application before the respondent authority for a new electricity connection after obtaining 'no objection' from her father-in-law who is owner of the aforesaid house as no electricity connection has been provided by the respondent authorities to the said house.

The grievance of the petitioner is that the respondent authority is sitting tight over the matter and is not issuing the electricity connection to the

petitioner despite repeated requests made by the petitioner.

Learned counsel for the respondents submits that no useful would be served in keeping the writ petition pending and appropriate direction may be issued to the respondent no.3 to consider the grievance of the petitioner.

Accordingly, considering the facts and circumstances of the case and without going into the merits of the case, the writ petition is disposed off permitting the petitioner to submit a fresh representation ventilating her grievances before the respondent no.3-Executive Engineer (Urban) Vidyut Vitaran Khand-IV, Bhelupur, District Varanasi along with a certified copy of this order within a period of one month from today. In case any such representation is filed by the petitioner, the respondent no.3 shall consider and decide the same by a reasoned and speaking order preferably within a period of one month thereafter.
