Petitioner claim the entitlement of promotional pay scale. A representation in this regard has been made by the petitioner but to no avail.
The only prayer made by the petitioner is that the grievance for payment of promotional dues be decided within a stipulated time frame. The first two prayers are not being pressed at this stage.
Learned Standing Counsel as well as learned counsel appearing for respondent nos. 4 & 5 contends that the claim of the petitioner requires factual adjudication in the light of applicable law by the competent authority in the first instance. However, they fairly submit that such determination is liable to be decided within a reasonable period of time.
In the wake of preceding discussion and without going
into the merits of the case, the respondent No.2- Director, Local Body, Directorate of Local Bodies, Gomati Nagar, Ext.-7, Lucknow shall decide the claim of the petitioner for promotional pay scale and other benefits as per law, preferably, within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
With the aforesaid direction, the writ petition is finally disposed of.
