Heard Shri Deepesh Kumar, Advocate holding brief of Shri Braj Mohan Singh, learned counsel for the petitioner, learned Standing Counsel for the State and Shri Harshit Pandey, learned counel appearing for respondent nos. 2 & 3.
The petitioner claim the benefit of assured career progression scheme. A representation in this regard has been made by the petitioners but to no avail.
Learned Standing Counsel contends that the claim of the petitioner requires factual adjudication in the light of applicable law by the competent authority in the first instance. However, he fairly submits that such determination is liable to be decided within a reasonable period of time.
In the wake of preceding discussion and without going into the merits of the case, the respondent No . 2- Commissioner Kanpur Nagar Nigam, Kanpur Nagar shall decide the claim of the petitioners for benefit of assured career progression scheme as per law, preferably, within a
period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
With the aforesaid direction, the writ petition is finally disposed of.
