Heard Shri Rajesh Shankar Srivastava, learned counsel for the petitioner, learned Standing Counsel for the Staterespondent No. 1 and Shri J. N. Maurya, learned counsel for the respondents No. 2 and 3.

The petitioner claims that the arrears of his salary and retiral dues have not been disbursed to him. He has made a representation in this regard but to no avail.

Learned counsels for the respondents submit that the matter requires determination of facts by the competent authority as per law in the first instance. However, they fairly contend that his claim for arrears of salary and retiral dues are liable to be decided by the competent authority in a reasonable time frame.

In light of the aforesaid submissions and without going into the merits of the case, the respondent No.2-Executive Director, U.P. State Employees Welfare Corporation, 742, Jawahar Bhawan, Lucknow is directed to decide the representation of the petitioner regarding arrears of salary and retiral dues as per law by a speaking order within a

period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation.

With the aforesaid direction, the writ petition is finally disposed of.
