The contention of learned Counsel for the writ petitioner is that the allegation on the basis whereof the writ petitioner has been placed under suspension is that the writ petitioner, while conducting investigation and submitting charge sheet, has included one of the accused who was innocent, and on his complaint, pursuant to the order of the higher authorities of the police, further investigation.

Submission is that once the charge sheet stood submitted and cognizance has been taken by the Magistrate and the it has attained finality, as stated in paragraph 5, then the writ petitioner could not have been placed under suspension on the said charge.
