Heard learned counsel for the petitioner, Mr. Ashok Kumar Singh, learned counsel for respondent nos.2, 3 & 4 as well as learned Standing Counsel for the State.

Learned counsel for the petitioner submits that the petitioner was appointed on the post of Assistant Teacher in the year 2020 pursuant to appointment letter dated 5.12.2020, at Prathmik Vidyalaya Jahda Mustahakan, Block Bhanwapur, District- Siddharth Nagar. A show cause notice has been given to the petitioner on 6.6.2025 by District Basic Education Officer, Siddharth Nagar, questioning his qualification to be appointed on the said post. He further submits that the petitioner is a regular employee and has submitted an explanation to the aforesaid show cause notice and he is regularly working in the institution as Assistant Teacher.

Learned counsel for the petitioner submits that the petitioner's services have not been dispensed with, neither has been placed under suspension. He further submits that merely on the basis of the show cause notice, the salary of the petitioner for the months of July, August and September 2025 has been stopped. Prima facie , so long as the employee continues in service and his services are not determined, in accordance with law, particularly when he is discharging his duties, payment of his salary cannot be restrained.

Learned counsel for respondent-B.S.A. informs that the petitioner is not

cooperating in the inquiry.

In view of the above, pursuant to the show cause notice, the petitioner has already submitted a reply, therefore, if required, he may be given a notice to appear before the authorities concerned for the purposes of inquiry, if any.

Put up this case, as fresh, on 27.10.2025.

Untill further orders of this Court, the petitioner shall be paid his current salary regularly, including the salary from the month of July, 2025.
