Tanuja Singh vs Amit Singh

Heard Sri H.G.S. Parihar, learned Senior Advocate, assisted by Ms. Meenakshi Singh Parihar and Sri Vaibhav Chauhan, learned counsel for the applicant and Sri Chandan Srivastava, Sri Abhinav Srivastava and Sri Anurup Kumar Srivastava, who put in appearance on behalf of the opposite party.

This Court had passed the order dated 25.11.2025, which reads as under:-

"1. Heard Sri H.G.S. Parihar, learned Senior Advocate, assisted by Ms. Pragya Singh, Advocate, holding brief of Ms. Meenakshi Singh Parihar, learned counsel for the applicant.

2. The present application under Section 24 of C.P.C. has been preferred by the applicant for transfer of the Matrimonial Suit/ Case bearing Case No. 242/2025 (Amit Singh Versus Smt. Tanuja Singh) under Section 13 of Hindu Marriage Act, pending before the Court of Principal Judge, Family Court, District- Raebareli to the Court of Principal Judge, Family Court, District- Pratapgarh.

Learned Senior Advocate appearing on behalf of the applicant submits that the applicant has two children; the elder son aged about 9 years and the younger son aged 6 years who is suffering from the ailment of 'autism'. It is stated on behalf of the applicant that applicant was subjected to harassment, physical assault and verbal abuse by the member of the matrimonial family who also passed derogatory remarks against the applicant's parental family. It is further stated on behalf of the applicant that when the applicant

expressed her desire to return from her parental home to the matrimonial home, the respondents deliberately refused to allow her to rejoin them, thereby causing her grave mental agony and hardship.

4. It is also submitted on behalf of the applicant that the applicant is facing financial hardship as she has no means to maintain herself and is entirely dependent upon her parents for livelihood. Due to lack of funds, she is under severe financial burden, which has caused her immense mental stress, anxiety and hardship in effectively pursuing and defending her case before the Court.

It is also stated that the applicant's husband, namely, Sri Amit Singh is a practicing advocate at Raebareli and is well-connected and influential in the local Bar and also among police authorities. Due to his professional standing and influence, the applicant has a bona-fide and reasonable apprehension that she will not be able to secure a fair and impartial hearing before the Court at Raebareli.

Learned Senior Advocate appearing on behalf of the applicant has relied upon a judgment passed by this Court in the case of Anamika Singh versus Sanjeev Kumar Singh passed in Transfer Application (Civil) No. 120 of 2019 as well as the judgment passed in the case of N.C.V. Aishwarya Versus A. S. Saravana Karthik Sha reported in 2022 SCC OnLine SC 1191.

7. Learned Senior Advocate appearing on behalf of the applicant stated that the dispute between the parties is matrimonial in nature and the same may be settled amicably through mediation.

8. Therefore, to know the consent of the parties for mediation, the presence of the applicant and the opposite party would be required on the next date.

9. Let notice be issued to the opposite party, through the Chief Judicial Magistrate, Raebareli.

10. Steps for service of notice be taken within three working days.

11. List on 12.12.2025 as fresh. On that date, the applicant as well as the opposite party shall appear in person before this Court.

12. The Senior Registrar of this Court shall ensure the communication of this order to the Chief Judicial Magistrate, Raebareli, for its compliance."

Pursuant to the aforesaid order, the applicant- Tanuja Singh and the opposite party-Amit Singh are present in person before this Court along with their respective counsel.

On being asked, the parties present in the Court have stated that they are willing to settle their dispute amicably through Mediation & Conciliation Centre of this Court

¶30

This Court invited Sri Shishir Jain, Secretary of the Mediation & Conciliation Centre of this Court and sought his assistance in the settlement of the dispute between the parties. He assured that if the matter is referred to the Mediation & Conciliation Centre of this Court, he shall try his level best to get the dispute settled.

Since, the parties are willing to settle their dispute amicably, therefore, the matter is referred to the Mediation & Conciliation Centre of this Court to provide assistance in the said settlement.

The first date of mediation/first session would be 18.12.2025.

The parties shall remain present in the Mediation & Conciliation Centre of this Court on 18.12.2025 to participate in the mediation proceeding.

The mediation proceeding may be conducted and concluded with expedition subject to proper cooperation of the parties.

The mediation report shall be submitted before this Court by the next date of listing.

List this case on 19^th January, 2026, as fresh.

¶37

On that date, the parties who are present in person need not personally appear before the Court again. However, either the mediation report shall be filed by the Mediation and Conciliation Centre or the status of the mediation proceedings shall be placed before this Court on the next date if the mediation proceedings could not be concluded.

When the case is next listed, the name of Sri Chandan Srivastava, Sri Abhinav Srivastava and Sri Anurup Kumar Srivastava, shall be printed in the cause list as counsel for the opposite party.
