At the very outset, learned counsel for the appellant has submitted that there are some incurable defects in the present appeal, therefore, she may be permitted to withdraw the same with liberty to file afresh with correct particulars.

Learned counsel for the respondent No. 1 has no objection to the aforesaid prayer.

Accordingly, the present appeal is dismissed as withdrawn, with liberty to the appellant to file the same afresh with correct particulars.
