Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

Learned counsel for the applicant has submitted that a maintenance case under Section 12 of Protection of Women from Domestic Violence Act was filed by the applicants which was decided in favour of the applicants by awarding maintenance award. From the very inception, when the maintenance case was filed by the applicants, the respondent/husband has not paid a single penny of maintenance amount. Compelled by non-compliance of the maintenance award by the respondent, Execution Case No.67310 of 2023 (Smt. Kulsum @ Sabina Bano and another Vs. Afjal & Ors.) under Section 31 of the aforesaid Act, Police Station Saraimamrej, District Prayagraj was filed by the applicants. It was further submitted by the learned counsel for the applicants that despite orders passed by the Family Court, the applicants are still destitute and are having no means to continue their livelihood. Learned counsel, therefore, prays that a direction be issued to the court concerned to decide the said case as expeditiously as possible.

Considering the submissions made by the learned counsel for the applicants, the court concerned is directed to decide the aforesaid execution case expeditiously and possible within a period of three months from the date of production of a certified copy of this order, provided there is no legal impediment.
