Heard counsel for the applicant, the complainant (whose counsel filed vakalatnama that day) and the State, which opposed bail on the ground that the offence was serious. वतर्मान दािण्डक प्रकीणर् जमानत प्राथर्ना पत्र आवेदक की ओर से मु०अ०सं० 199/2025, अंतगर्त धारा 64(1), 352, 351(3) बी.एन.एस., थाना मांट, िजला मथुरा में जमानत पर मुक्त करने हेतु प्रस्तुत िकया गया है।

पिरवादी के िवद्वान अिधवक्ता श्री िहमांशु िमश्रा की तरफ से आज वकालतनामा दािखल िकया गया, िजसे पत्रावली पर रखा जाय।

आवेदक के िवद्वान अिधवक्ता, पिरवादी के िवद्वान अिधवक्ता एवं राज्य की तरफ से िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

आवेदक के िवद्वान अिधवक्ता ने तकर् प्रस्तुत िकया िक आवेदक को इस प्रकरण में गलत एवं फजीर् ढंग से झूठा फंसाया गया है, उसने किथत अपराध कािरत नहीं िकया है। आवेदक द्वारा ऐसा कोई भी कृत्य कािरत नहीं िकया गया है, जैसािक प्राथिमकी में विणत िकया गया है। प्राथिमकी लगभग 10 माह के िवलम्ब से पंजीकृत करायी गयी है तथा प्राथिमकी में घटना की ितिथ एवं समय अंिकत नहीं िकया गया है। पीिड़ता शादीशुदा वयस्क मिहला है तथा आवेदक द्वारा पीिड़ता को बहला-फुसलाकर अथवा धमकी देकर कोई गलत कृत्य कािरत नहीं िकया गया है। पीिड़ता ने अपने बयानों में अश्लील वीिडयो िरकॉिडग की बात कही है, िकन्तु आवेदक के पास से िकसी प्रकार के अश्लील वीिडयो की बरामदगी नहीं पायी गयी है। दौरान िववेचना पीिड़ता द्वारा अपना िलिखत बयान पुिलस के समक्ष दजर् कराया गया, िजसमें पीिड़ता ने कथन िकया िक मैं अपनी मजीर् से अपनी ससुराल से गई थी, मुझे कोई लेकर नहीं गया था और मैं अपने पित योगेन्द्र के साथ नहीं रहना चाहती हूँ। पुिलस के समक्ष िदए गए बयान से यह सािबत होता है िक उस पर िकसी प्रकार का कोई दबाव नहीं था, अपनी स्वेच्छा से रह रही थी। पीिड़ता द्वारा स्वयं मिहला थाने पर िदनांक 23.07.2025 को अपने पित व ससुरालीजन के िखलाफ एक िशकायती प्राथर्नापत्र िदया गया। उक्त तथ्यों से यह पूणर्तः स्पष्ट है िक आवेदक को मात्र िमथ्या रूप से वतर्मान प्राथिमकी में अिभयुक्त बना िदया गया है। पीिड़ता के बयानों एवं प्राथिमकी के तथ्यों में परस्पर िवरोधाभास है। पुनः उनका यह भी कथन है िक आवेदक की तरफ से यह आश्वासन िदया गया है िक वह कानून की प्रिक्रया में सहयोग करने के िलए तैयार है और जब भी आवश्यकता होगी वह ईमानदारी से अदालत के समक्ष खुद को उपलब्ध कराएगा और उन सभी शतोर्ं को स्वीकार करने के िलए भी तैयार है जो न्यायालय उस पर अिधरोिपत करेगी। आवेदक िनदोर्ष है तथा वह इस प्रकरण में िद० 14.09.2025 से कारागार में िनरुद्ध है।

इसिलए आवेदक को जमानत पर छोड़ िदया जाय।

पिरवादी के िवद्वान अिधवक्ता िवद्वान अपर शासकीय अिधवक्ता ने आवेदक के जमानत का प्रबल िवरोध करते हुए तकर् प्रस्तुत िकया िक आवेदक द्वारा कािरत अपराध स ं ज्ञेय एवं गंभीर प्रकृित का है, इसिलए आवेदक को जमानत पर न छोड़ा जाय।

उभयपक्ष के िवद्वान अिधवक्तागण के तकोर्ं के पिरप्रेक्ष्य में पत्रावली पर उपलब्ध सारवान तथ्यों एवं पिरिस्थितयों का समग्र रूप से अवलोकन करने के बाद, सबूतों की प्रकृित और िकसी भी ठोस िवरोधात्मक सामग्री की अनुपिस्थित एवं उपलब्ध सामग्री से छेड़छाड़ की संभावना न होने के तथ्य को देखते हुए मेरी राय में आवेदक को जमानत पर मुक्त करने का उपयुक्त आधार है।

अतः वाद के गुण-दोष पर िबना कोई िटप्पणी िकए हुए आवेदक को उपरोक्त विणत अपराध में संबंिधत न्यायालय की संतुिष्ट पर व्यिक्तगत बंध-पत्र एवं अिधक धनरािश के दो स्थानीय प्रितभू प्रस्तुत करने पर िनम्निलिखत शतोर्ं के साथ जमानत पर छोड़ िदया जाय।

i. आवेदक िववेचना या परीक्षण के दौरान अिभयोजन साक्ष्यों के साथ छेड़छाड़ नहीं करेगा।

ii. आवेदक अिभयोजन सािक्षयों व पीिड़ता/ िशकायतकतार् को डरायेगा/धमकायेगा नहीं।

iii. आवेदक न्यायालय के आदेशों का पालन करेगा, वह परीक्षण के दौरान िबना कोई अनावश्यक स्थगन िलए िनयत ितिथ पर न्यायालय में उपिस्थत होगा तथा परीक्षण में ईमानदारी से सहयोग करेगा।

iv. आवेदक जमानत पर िरहा होने के बाद जमानत की स्वतंत्रता का दुरूपयोग नही करेगा और िकसी भी अपरािधक गितिविध में िलप्त नहीं होगा न कोई अपरािधक कृत्य करेगा।

v. आवेदक प्रत्यक्ष या अप्रत्यक्ष रूप से मामले के तथ्यों से पिरिचत िकसी भी व्यिक्त या पुिलस अिधकािरयों को कोई प्रलोभन या धमकी नहीं देगा न ही उनसे कोई वायदा करेगा, िजसके कारण उन्हें न्यायालय में तथ्यों को उजागर करने से िवरत रहना पडे़।

उपरोक्त शतोर्ं में से िकसी के उल्लंघन के मामले में, परीक्षण न्यायालय आवेदक की जमानत िनयमानुसार रद्द करने को स्वतंत्र है।
