ALLAHABAD HIGH COURT (Dr. Gautam Chowdhary, J.) allowed the bail application of Kamalu arising out of Case Crime No. 0158 of 2025 under Sections 2(b)(xi), 2(b)(xvii) and 3(1) of the U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986 (P.S. Gida, District Gorakhpur). The applicant had been in jail since 22.07.2025; counsel urged that the gang-chart disclosed only a single punishment case, in which the applicant was already on bail, and that no fear of the applicant prevailed in society. Considering the nature of the evidence, the absence of any concrete opposing material and the unlikelihood of tampering with the available material, the Court enlarged the applicant on bail on a personal bond and two sureties each in the like amount, subject to conditions (I)-(V) covering non-tampering with evidence, non-intimidation of witnesses, regular attendance and cooperation in trial, non-misuse of liberty, and no inducement or threat to witnesses or police officers, reserving to the trial court the power to cancel bail for breach, and without expressing any opinion on the merits of the case.

वतर्मान दािण्डक प्रकीणर् जमानत प्राथर्ना पत्र आवेदक की ओर से मु०अ०सं० 0158 सन् 2025, अंतगर्त धारा 2(b)(xi), 2(b)(xvii), 3(1) उ०प्र० िगरोहबंद एवं समाज िवरोधी िक्रयाकलाप (िनवारण) अिधिनयम, 1986, थाना गीडा, िजला गोरखपुर में जमानत पर मुक्त करने हेतु प्रस्तुत िकया गया है।

आवेदक के िवद्वान अिधवक्ता एवं राज्य की तरफ से िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

आवेदक के िवद्वान अिधवक्ता ने तकर् प्रस्तुत िकया िक आवेदक को इस प्रकरण में गलत एवं फजीर् ढ़़़ंग से झूठा फंसाया गया है, उसने किथत अपराध कािरत नहीं िकया है। आवेदक न तो िकसी गैंग का सदस्य है, न ही िकसी गैंग का मुिखया है, न ही अपने आिथक अथवा भौितक लाभ हेतु कोई अवांछनीय कृत्य िकया है। आवेदक का समाज में कोई भय व्याप्त नहीं है। पुिलस द्वारा मनगढ़़़़त कहानी बताकर आवेदक को उपरोक्त वाद में आरोिपत कर िदया गया है। गैंगचाटर् में दिशत िजस एक मात्र दंड वाद के आधार पर आवेदक के िवरुद्ध गैंगस्टर अिधिनयम की कायर्वाही की गई है, उपरोक्त में आवेदक जमानत पर है। आवेदक इस प्रकरण में िद० 22.07.2025 से कारागार में िनरुद्ध है। आवेदक के पलाियत होने अथवा िवचारण को प्रभािवत करने की संभावना प्रतीत नहीं होती है, इसिलए आवेदक को जमानत पर छोड़ िदया जाय।

िवद्वान अपर शासकीय अिधवक्ता द्वारा आवेदक के जमानत का प्रबल िवरोध िकया गया।

आवेदक के िवद्वान अिधवक्ता के तकोर्ं के पिरप्रेक्ष्य में पत्रावली पर उपलब्ध सारवान तथ्यों एवं पिरिस्थितयों का समग्र रूप से अवलोकन करने के बाद, सबूतों की प्रकृित और िकसी भी ठोस िवरोधात्मक सामग्री की अनुपिस्थित एवं उपलब्ध सामग्री से छेड़छाड़ की संभावना न होने के तथ्य को देखते हुए मेरी राय में आवेदक को जमानत पर मुक्त करने का उपयुक्त आधार है।

अतः वाद के गुण-दोष पर िबना कोई िटप्पणी िकए हुए आवेदक को उपरोक्त विणत अपराध में संबंिधत न्यायालय की संतुिष्ट पर व्यिक्तगत बंध-पत्र एवं उसी धनरािश के कोई भी दो प्रितभू प्रस्तुत करने पर िनम्निलिखत शतोर्ं के साथ जमानत पर छोड़ िदया जाय।

(I) आवेदक िववेचना या परीक्षण के दौरान अिभयोजन साक्ष्यों के साथ छेड़छाड़ नहीं करेगा।

(II) आवेदक अिभयोजन सािक्षयों व पीिड़ता/िशकायतकतार् को डरायेगा/धमकायेगा नहीं।

(III) आवेदक न्यायालय के आदेशों का पालन करेगा, वह परीक्षण के दौरान िबना कोई अनावश्यक स्थगन िलए िनयत ितिथ पर न्यायालय में उपिस्थत होगा तथा परीक्षण में ईंमानदारी से सहयोग करेगा।

(IV) आवेदक जमानत पर िरहा होने के बाद जमानत की स्वतंत्रता की दुरूपयोग नहीं करेगा और िकसी भी आपरािधक गितिविध में िलप्त नहीं होगा न कोई आपरािधक कृत्य करेगा।

(V) आवेदक प्रत्यक्ष या अप्रत्यक्ष रूप से मामले के तथ्यों पिरिचत िकसी भी व्यिक्त या पुिलस अिधकािरयों को कोई प्रलोभन या धमकी नहीं देगा न ही उनसे कोई वायदा करेगा, िजसके कारण उन्हें न्यायालय में तथ्यों को उजागर करने से िवरत रहना पड़े।

उपरोक्त शतोर्ं में से िकसी के उल्लंघन के मामले में, परीक्षण न्यायालय आवेदक की जमानत िनयमानुसार रद्द करने को स्वतंत्र है।
