Anticipatory Bail Application U/S 482 BNSS No.- 7313 of 2025: applicants Tinkoo, Jeetendra Singh, Roop Kishor and Vikas Chaudhary sought anticipatory bail in Case Crime No. 0094/2023, PS Mahuakheda, district Aligarh (Sections 147, 148, 307, 504, 34 IPC). This was their second application — the first had been dismissed for non-appearance (adam pairvi). Weighing the submissions of both sides, the nature and gravity of the allegations, the applicants' alleged role and the established principles of anticipatory-bail law invoked from Siddharam Satlingappa Mhetre v. वतर्मान दािण्डक प्रकीणर् अिग्रम जमानत प्राथर्ना पत्र आवेदकगण िटकू, जीतेन्द्र िसह, रूप िकशोर, िवकास चौधरी की ओर से मु०अ०स० 0094/2023 अन्तगर्त धारा 147/ 148/ 307/ 504/ 34 भा.दं.सं, थाना महुवाखेड़ा, िजला अलीगढ़़़़ में अिग्रम जमानत पर मुक्त करने हेतु प्रस्तुत िकया गया है।

आवेदकगण के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

यह आवेदक का िद्वतीय अिग्रम जमानत आवेदन पत्र है, प्रथम जमानत आवेदन पत्र अदम पैरवी में िनरस्त कर िदया गया था।

आवेदकगण के िवद्वान अिधवक्ता ने तकर् प्रस्तुत िकया िक आवेदकगण िनदोर्ष है, उसे उपरोक्त धाराओं में द्वेषवश तंग व परेशान करने की िनयत से आिलप्त िकया गया है, िजस कारण र ं िजशन वादी मुकदमा द्वारा उक्त मुकदमा दायर िकया गया। उसे आशंका है िक उसे उपरोक्त विणत मामले में िगरफ्तार िकया जा सकता है, जबिक उसके िवरूद्ध कोई िवश्वसनीय साक्ष्य नहीं है। आवेदकगण दारा प्राथिमकी में दिशत उपरोक्त धाराओं का अपराध कािरत नहीं िकया गया है। आवेदकगण की ओर से यह भी आश्वासन िदया गया है िक वह कानून की प्रिक्रया में सहयोग करने के िलए तैयार है और जब भी आवश्यकता होगी वह ईमानदारी से न्यायालय के समक्ष खुद को उपलब्ध कराएगा और उन सभी शतोर्ं को स्वीकार करने के िलए भी तैयार है जो न्यायालय उस पर अिधरोिपत करेगी।

िवद्वान अपर शासकीय अिधवक्ता द्वारा यह तकर् प्रस्तुत िकया गया िक इस मामले में अिभयुक्तगण के िवरूद्ध पयार्प्त साक्ष्य के आधार पर िवचारण न्यायालय द्वारा अिभयुक्तगण को

तलब िकया गया है तथा िवचारण न्यायालय के प्रश्नगत आदेश में कोई िविधक त्रुिट पिरलिक्षत नहीं है, इसके कारण प्रश्नगत आदेश में कोई हस्तक्ष े प िकये जाने की आवश्यकता प्रतीत नही हो रही है। आवेदक का यह िद्वतीय अिग्रम जमानत आवेदन पत्र है, आवेदक के िवद्वान अिधवक्ता आवेदक के पक्ष में कोई भी नया तथ्य प्रकाश में नही आया है। इसिलए अिभयुक्तगण द्वारा कािरत अपराध गंभीर प्रकृित का है इसिलए आवेदकगण को अिग्रम जमानत पर मुक्त िकये जाने का कोई औिचत्य प्रतीत नहीं होता है अतः अिभयुक्तगण का अिग्रम जमानत आवेदन पत्र िनरस्त िकया जाय।

यह कहा जा सकता है िक Siddharam Satlingappa Mhetre v. State of Maharashtra, (2011) 1 SCC 694, के मामले में माननीय उच्चतम न्यायालय ने माना है िक अिग्रम जमानत पर िनणर्य करते समय न्यायालय को आरोप की प्रकृित और गंभीरता, अिभयुक्त का पूवर्वृत्त, अिभयुक्त के न्याय से भागने की संभावना पर िवचार करना चािहए तथा न्यायालय को अिभयुक्त के िवरुद्ध उपलब्ध संपूणर् सामग्री का सावधानीपूवर्क मूल्यांकन करना चािहए तथा अिभयुक्त की सटीक भूिमका को भी ध्यान में रखना चािहए।

वतर्मान मामले में अिग्रम जमानत संबंधी िविध के स्थािपत िसद्धांतों को ध्यान में रखते हुए और पक्षकारों के िवद्वान अिधवक्ताओं के कथनों, आरोपों की प्रकृित, आवेदकगण की भूिमका और मामले के सभी तथ्यों एवं पिरिस्थितयों को ध्यान में रखते हुए एवं सम्पूणर् दस्तावेजों के अवलोकन से यह िविदत होता है िक आवेदकगण द्वारा पूवर् में िदये गये अंतिरम आदेश का दुपर्योग िकया जा रहा है। अतः मामले के गुण-दोष पर िबना कोई िवचार व्यक्त िकए यह अिग्रम जमानत आवेदन पत्र स्वीकार िकए जाने योग्य नहीं है, तद्रुसार आवेदकगण का अिग्रम जमानत आवेदन पत्र अस्वीकार िकया जाता है।

उपरोक्तानुसार वाद के गुण-दोष पर िटप्पणी िकये बगैर यह अिग्रम जमानत प्राथर्नापत्र िनरस्त िकया जाता है।

इस वाद में यिद कोई अंतिरम आदेश हो, तो वह स्वतः समाप्त समझा जाए।

आवेदकगण िनयिमत जमानत प्राथर्नापत्र दािखल करने हेतु स्वतंत्र है। कायार्लय को िनदेर्िशत िकया जाता है िक इस आदेश की एक प्रितिलिप अिवलम्ब संबंिधत िवचारण न्यायालय के भेजना सुिनिश्चत करें।
