वतर्मान दािण्डक प्रकीणर् जमानत प्राथर्ना पत्र आवेदक की ओर से मु०अ०सं० 659/2020, अंतगर्त धारा 147, 452, 323, 504, 506, 427, 376, 325 भा.दं.सं., थाना मेजा, िजला प्रयागराज में जमानत पर मुक्त करने हेतु प्रस्तुत िकया गया है।

आवेदक के िवद्वान अिधवक्ता श्री लिलत कुमार गोंड एवं राज्य की तरफ से िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

यह आवेदक का तृतीय जमानत प्राथर्नापत्र है। आवेदक का प्रथम एवं िद्वतीय जमानत प्राथर्नापत्र क्रमशः िदनांक 22.02.2023 एवं 13.02.2024 को िनरस्त िकया जा चुका है।

आवेदक के िवद्वान अिधवक्ता की तरफ से आज पूरक शपथपत्र दािखल िकया गया, िजसे पत्रावली पर रखा जाय।

आवेदक के िवद्वान अिधवक्ता ने तकर् प्रस्तुत िकया िक आवेदक को इस प्रकरण में गलत एवं फजीर् ढ़़़ंग से झूठा फंसाया गया है, उसने किथत अपराध कािरत नहीं िकया है। उभयपक्ष के मध्य हुए भूिम िववाद की वजह से आवेदक को वतर्मान घटना में िमथ्यारोिपत िकया गया है। आवेदक द्वारा पीिड़ता के साथ किथत दुराचार कािरत नहीं िकया गया है। चूंिक यह आवेदक का तृतीय जमानत प्राथर्नापत्र है, अतः आवेदक के िवद्वान अिधवक्ता द्वारा नवीन तथ्य के रूप में यह कथन िकया गया है िक दौरान सत्र परीक्षण डॉक्टर दुष्यंत कुमार िसह का बयान पी.डब्ल्यू.-2 के रूप में िदनांक 21.08.2025 को अंिकत िकया गया है, िजसमें उनके द्वारा कथन िकया गया है िक "यह चोटें साधारण थी। तीनों के शरीर पर आयी चोटें – एवं साधारण थे। उसके शरीर पर कटकसे की कोई चोट नहीं पायी गयी थी। इसकी चोटें ठोस जमीन पर िगरने से आ सकती है। मजरूबा ( किथत पीिड़ता ) ने मुझे यह बात नहीं बतायी थी िक उसके साथ बलात्कार हुआ है। यिद वह बताती िक मैं उसका िचिकत्सीय परीक्षण नहीं करवाता। बिल्क उसके परीक्षण के िलए मिहला िचिकत्सक के िलए अग्रसािरत कर देता। इनके शरीर पर भी आयी चोटें साधारण थीं। जो नाली में पैर पड़ने से , मोच आने िगर पड़ने से आ सकती है। उसके बायें हाथ पर आयी चोट कटकासे की नहीं है िगरने से आ सकती है।” उक्त तकर् से यह पिरलिक्षत हो रहा है िक पीिड़ता द्वारा जानबूझकर आवेदक के िवरुद्ध प्रश्नगत किथत आरोप लगाया गया एवं पी. डब्ल्यू.-2 के बयान से अिभयोजन कथानक का समथर्न होता पिरलिक्षत नहीं हो रहा है। पुनः उनका यह भी कथन है िक आवेदक की तरफ से यह आश्वासन िदया गया है िक वह कानून की प्रिक्रया में सहयोग करने के िलए तैयार है और जब भी आवश्यकता होगी वह ईमानदारी से

अदालत के समक्ष खुद को उपलब्ध कराएगा और उन सभी शतोर्ं को स्वीकार करने के िलए भी तैयार है जो न्यायालय उस पर अिधरोिपत करेगी। आवेदक िनदोर्ष है तथा वह इस प्रकरण में िद० 29.11.2022 से कारागार में िनरुद्ध है। इसिलए आवेदक को जमानत पर छोड़ िदया जाय।

िवद्वान अपर शासकीय अिधवक्ता ने आवेदक के जमानत का प्रबल िवरोध करते हुए तकर् प्रस्तुत िकया िक आवेदक द्वारा कािरत अपराध स ं ज्ञेय एवं गंभीर प्रकृित का है, इसिलए आवेदक को जमानत पर न छोड़ा जाय।

आवेदक के िवद्वान अिधवक्ता के तकोर्ं के पिरप्रेक्ष्य में पत्रावली पर उपलब्ध सारवान तथ्यों एवं पिरिस्थितयों का समग्र रूप से अवलोकन करने के बाद, सबूतों की प्रकृित और िकसी भी ठोस िवरोधात्मक सामग्री की अनुपिस्थित एवं उपलब्ध सामग्री से छेड़छाड़ की संभावना न होने के तथ्य को देखते हुए मेरी राय में आवेदक को जमानत पर मुक्त करने का उपयुक्त आधार है।

अतः वाद के गुण-दोष पर िबना कोई िटप्पणी िकए हुए आवेदक को उपरोक्त विणत अपराध में संबंिधत न्यायालय की संतुिष्ट पर व्यिक्तगत बंध-पत्र एवं अिधक धनरािश के कोई भी दो प्रितभू प्रस्तुत करने पर िनम्निलिखत शतोर्ं के साथ जमानत पर छोड़ िदया जाय।

i. आवेदक िववेचना या परीक्षण के दौरान अिभयोजन साक्ष्यों के साथ छेड़छाड़ नहीं करेगा। ii. आवेदक अिभयोजन सािक्षयों व पीिड़ता/ िशकायतकतार् को डरायेगा/धमकायेगा नहीं। iii. आवेदक न्यायालय के आदेशों का पालन करेगा, वह परीक्षण के दौरान िबना कोई अनावश्यक स्थगन िलए िनयत ितिथ पर न्यायालय में उपिस्थत होगा तथा परीक्षण में ईमानदारी से सहयोग करेगा।

iv. आवेदक जमानत पर िरहा होने के बाद जमानत की स्वतंत्रता का दुरूपयोग नही करेगा और िकसी भी अपरािधक गितिविध में िलप्त नहीं होगा न कोई अपरािधक कृत्य करेगा। v. आवेदक प्रत्यक्ष या अप्रत्यक्ष रूप से मामले के तथ्यों से पिरिचत िकसी भी व्यिक्त या पुिलस अिधकािरयों को कोई प्रलोभन या धमकी नहीं देगा न ही उनसे कोई वायदा करेगा, िजसके कारण उन्हें न्यायालय में तथ्यों को उजागर करने से िवरत रहना पडे़।

उपरोक्त शतोर्ं में से िकसी के उल्लंघन के मामले में, परीक्षण न्यायालय आवेदक की जमानत िनयमानुसार रद्द करने को स्वतंत्र है। संबंिधत िवचारण न्यायालय को यह भी िनदेर्िशत िकया जाता है िक मामले से संबंिधत सत्र परीक्षण का िनस्तारण शीघ्रता के आधार पर यथाशीघ्र करना सुिनिश्चत िकया जाए।
