Supplementary affidavit filed by learned counsel for the applicant, which is taken on record.

Heard Sri Yasir, Advocate, holding brief of Sri Shams Uz Zaman, learned counsel for the applicant, Sri Rakesh Kumar Singh, learned A.G.A. and perused the record.

The instant application has been filed to enlarge the applicant on bail in case crime no. 541 of 2024, under sections 323, 506, 307, 147, 148, 149, 120-B I.P.C., Police Station-Majhola, District Moradabad.

Contention of learned counsel for the applicant is that general allegation has been assigned to all the accused persons including the applicant herein, in the alleged incident, as per the statement of the injured as well as F.I.R. It is further submitted that co-accused persons namely Yash Chaudhary @ Yash Gurjar, Aayush Rajpoot @ Aayush Gahlot, Nitin Saini @ Daivil, Arpit Madan, Ritik Anand, AMan Thakur @ Aman Singh Bora have already been released on bail vide orders dated 30.08.2024, 05.09.2024, 11.09.2024, 25.09.2024, 18.10.2024, 11.02.2025 passed in Bail Application Nos. 31875 of 2024, 33023 of 2024, 32671 of 2024, 35677 of 2024, 37947 of 2024, 46624 of 2024, respectively. Role of the applicant is similar to the coaccused persons, who are on bail, hence applicant is seeking parity. The applicant is a law abiding citizen and he is languishing in jail since 02.06.2025 having no previous criminal history. Charge-sheet has been submitted in this case against the applicant and there is no custodial interrogation requires. In case, he is granted bail, he will not misuse the

liberty of bail and would cooperate in the trial proceedings.

On the other hand, learned A.G.A. for the State opposed the prayer for bail, but he could not dispute the aforesaid fact.

Thus, considering the entire facts and circumstances of the case, submissions of learned counsel for the parties and keeping in view the nature of offence, evidence, complicity of accused and without expressing any opinion on the merits of the case, I am of the opinion that the applicant is entitled to be enlarged on bail on the ground of parity with the aforesaid coaccused persons.

Let the applicant- Vaibhav Singh, involved in the aforementioned crime be released on bail, on his furnishing a personal bond and two sureties each in the like amount, to the satisfaction of the court concerned, with the following conditions:-

i. The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.

ii. The applicant shall cooperate in the trial/investigation sincerely without seeking any adjournment.

iii. The applicant shall not indulge in any criminal activity or commission of any crime after being released on bail.

iv. The applicant shall attend in accordance with the conditions of the bond executed by him.

In case of breach of any of the above conditions, it shall be a ground for cancellation of bail.

Identity, status and residence proof of the applicant and sureties be verified by the court concerned before the bonds are accepted.
