Heard Sri Dilip Kumar Tiwari, learned counsel for the petitioner and Sri Yogesh Kumar Awasthi, learned Standing Counsel for the State.

Present petition has been filed for the following relief:

"WHEREFORE it is most respectfully prayed that this Hon'ble Court may graciously be pleased to direct the opposite party no. no.1, i.e. Settlement Consolidation Officer, Consolidation, Gauriganj, District-Amethi to decide the appeal no. 370/2015-16 Computerised case no. T2015047102 (Benchu and others Vs. Prabhawati & others) U/s 11(1) of UPCH Act, pending before him since 2015, expeditiously within a period as fixed by this Hon'ble Court, which is contained as annexure no. 1 with this petition, in the interest of justice."

Contention of learned counsel for the petitioner is that the appeal no.370 of 2015-16, u/s 11(1) of U.P. Consolidation of Holding Act, 1953, has been pending since 2016 and same may be directed to be decided, expeditiously.

Considering the aforesaid submission and on perusal of record, it appears that the aforesaid appeal could not be decided for various reason including the strike of Bar as well as engagement of Presiding Officer in some other official work.
