Heard Ms Archana Shukla, Advocate, holding brief of Sri Vijayendra Prakash Tripathi, learned counsel for the petitioner, Sri Mohan Singh, learned counsel for the Gaon Sabha and Sri Yogesh Kumar Awasthi, learned Standing Counsel for the State.

2. Present petition has been filed for the following relief:

"WHEREFORE, it is most respectfully prayed that this Hon'ble Court may graciously be pleased to direct to the Court of Sub Divisional Magistrate (Judicial) TehsilSohawal District- Ayodhya to 3754/2023 to decide the case No.3754 of 2023 & Computerized T202304230203754, under section 116 of U.P revenue Code filed by the petitioner under order 07 Rule 01 titled " Vijay Kumar Verma vs Ashok Kumar and another" pending before him, expeditiously as early as possible within a prescribe time, in the interest of justice.

It is further prayed that this Hon'ble Court may kindly pleased to direct the opposite party not to create any third party right till the disposal of the interim relief application filed by the petitioner under order 07 Rule 01 & under section 116 of U.P revenue Code titled "Vijay Kumar Verma vs Ashok Kumar and another" filed in suit no. 3754/2023 & Computerized No. T202304230203754 pending before the Sub Divisional Magistrate (Judicial) Tehsil- Sohawal District- Ayodhya."

Contention of learned counsel for the petitioner is that the suit u/s 116 of U.P. Revenue Code, 2006 (in short 'the Code, 2006'), has been pending since 2023 and preliminary decree was also prepared on 06.09.2024 but till date final proceeding has not been concluded. Therefore, direction may be issued to the respondent no.1 to conclude the proceeding in case no.3754 of 2023.

Considering the aforesaid submission and taking into account the

order sheet of the present case, present petition is disposed of with a direction to the respondent no.1 to decide the case no.3754 of 2023, u/s 116 of the Code, 2006, as expeditiously as possible, in light of the judgement of this court in Daya Shankar vs. State of U.P. and 4 others reported in 2023(6) ADJ 181 , dated 19.05.2023.
