Respondent No.2's 1999 application under Section 12 (relying on an unregistered will dated 5.5.1997 by Gurdeen in favour of respondent No.2 and one Ramasrey) was allowed on 30.1.2015 by the Consolidation Officer, but was recalled on 2.8.2016 on the application of the petitioner and Gurdeen's legal heirs; respondent No.2's revision was dismissed on 27.12.2019 with directions to complete the Section 12 proceeding. Respondent No.2's application to delete the petitioner as a party, rejected on 19.2.2025 and sustained by dismissal of the appeal on 17.7.2025, nevertheless succeeded in revision before the D.D.C. (Revision No. 512 of 2025 under Section 48) by order dated 11.11.2025, with remand to the C.O. Held: as the petitioner contested the proceeding up to revision level and his name stood recorded on the basis of the 2000 sale deed, he has the right to contest the Section 12 proceeding; hearing him would not prejudice respondent No.2; the revisional order was absolutely erroneous. Petition disposed of with the consent of both parties; order dated 11.11.2025 set aside; petitioners directed to participate in the Section 12 proceeding.
