Petitioner Anshoo Gupta, whose arranged marriage of 09/02/2014 had broken down, sought via Article 227 a direction to respondent no.1, the learned Principal Judge, Family Court, Distt. Faizabad, to fix a date and expeditiously decide pending mutual-consent divorce Case No.123/2025, 'Anshoo Gupta Vs. Arti Gupta', preferred u/s 13B of the Hindu Marriage Act. Following a compromise of 27/10/2025 signed by the parties and witnesses (agreement to withdraw all inter-se cases and seek mutual divorce), the 13-B petition lay pending before the Family Court at Ayodhya/Faizabad with 29/11/2025 stated to be the court-fixed date, coinciding with the petitioner's planned remarriage. Heard learned counsel for the petitioner.

The instant petition has been preferred under Article 227 of the Constitution of India with the following prayers:-

"a. Issue an order or direction in the appropriate nature, directing thereby the respondent no.1, to fix date as early as possible and decide the case No.123/2025, "Anshoo Gupta Vs. Arti Gupta (preferred u/s 13B of Hindu Marriage Act, for mutual divorce); expeditiously, preferably by 28/11/2025.

b. Issue, any other, Order or direction as is deemed fit and proper under the circumstances of the case."

Learned counsel for the petitioner submitted that the petitioner and the respondent no.2 are husband and wife. Their marriage (arranged marriage) took place on 09/02/2014, according to Hindu rights and rituals. The relationship between the spouses soured during the course of time due to some matrimonial differences and when they were not able to reconcile, despite much efforts, they filed cases. They entered into a compromise on 27/10/2025, which was signed by the parties as well as the witnesses, wherein they agreed to resolve their differences, withdraw all the cases filed by them against each other and move a petition under Section 13-B of Hindu Marriage Act and get the petition under Section

He next submits that the petition under Section 13-B of Hindu Marriage Act is pending before the court of the learned Principal Judge (Family Court), Ayodhya/Faizabad, in Case No.123 of 2025 "Anshoo Gupta Vs. Arti Gupta". The marriage of the petitioner has been settled and is likely to be performed this month i.e., on 29/11/2025, which is the date fixed by the court in the case. In the said petition for divorce, therefore, some proper direction may kindly be given to the court concerned to expedite the hearing of the case.

The court concerned is considering the limited prayer made in the petition. The court concerned is directed to hear and decide the petition under Section 13-B of the Hindu Marriage Act, as expeditiously as possible after giving an opportunity of hearing to the parties, provided there is no legal impediment.

With the above direction, the petition stands disposed of.
