Heard Sri Vineet Kumar Chaurasia, learned counsel for the petitioner, learned Standing counsel for respondent Nos. 1 and 2.

It has been submitted on behalf of the petitioner that petitioner is recorded tenure holder and in actual possession of agricultural land being Gata No. 1528Ka, area 0.21 hectares, situated in Village - Sarwan, Pargana - Rokha, Tehsil - Tiloi, District - Amethi. Since the boundaries of the aforesaid land were not clear, petitioner moved an application under Section 24 of the U.P. Revenue Code, 2006 before Sub Divisional Magistrate, Tiloi, Amethi seeking fixation of boundaries of the aforesaid land. The application preferred by the petitioner was duly registered as Case No. 4411 of 2021, wherein notices were issued to all the opposite parties therein. The opposite parties to the application, did not appeared nor filed any objection. The Sub Divisional Magistrate called for report from the concerned revenue official and to prepare site inspection report, pursuant to which a inspection report was submitted on 20.07.2021. The Tehsildar, Tiloi after examining the report forwarded the same with his comments to the Sub Divisional Magistrate.

After considering the relevant material available on record, the Sub Divisional Magistrate passed order dated 16.08.2021, allowing the application of petitioner and issued directions for fixation of boundaries of the said land. Against order dated 16.08.2021, no appeal or revision was preferred by any of the opposite parties. Grievance of petitioner is that despite several representations/applications having been moved by the petitioner before the concerned revenue officials, the order dated 16.08.2021, has not been acted upon by them, and hence present writ petition has been filed, seeking execution of the order dated 16.08.2021, passed by the Sub Divisional Magistrate.

Learned Standing counsel, on the other hand, submits that the petitioner has equally efficacious and alternate remedy of executing the orders of revenue court as per Para 460 of U.P. Revenue Court Manual where an order of revenue authority can be executed.

At this stage, learned counsel for the petitioner submits that liberty may be granted to the petitioner to approach the competent authority under Para 460 of U.P. Revenue Court Manual for execution of the orders passed by the Prescribed Authority as well as of the other authorities.

Accordingly, the petition is disposed of with liberty to the petitioner to approach competent authority by moving appropriate application under para 460 of Revenue Court Manual to execute the orders of the revenue authorities. In case, such an application is moved within two weeks from today the same shall be disposed of expeditiously.
