Heard Sri Ganga Prasad Mishra, learned counsel for the petitioner as well as learned Standing Counsel for respondent nos. 1 and 2.

In the light of proposed order notice to private respondent is dispensed with.

It has been submitted by learned counsel for the petitioner that petitioner has assailed order dated 28.02.2007, passed by the Deputy Director of Consolidation, Ayodhya, wherein on the reference submitted by the Settlement Officer Consolidation, the Deputy Director of Consolidation has passed the impugned order.

It is the case of the petitioner that the Deputy Director of Consolidation has not issued notice Shiv Shankar or to his legal heirs including the petitioner, who is in possession of the disputed property.

Learned Standing Counsel on the other hand has opposed the writ petition. He has submitted that the petitioner has assailed order dated 28.02.2007 after extremely long length of time of 18 yeas and no satisfactory explanation has been stated for the delay caused.

Apart from the aforesaid, it is the case of the petitioner that impugned order has been passed ex-parte without hearing him.

In this regard, the petitioner has alternate remedy to move appropriate

application for recall before the competent authority.

In the light of above, present writ petition is disposed of with liberty to the petitioner to move appropriate application for recall against order dated 28.02.2007, before the competent authority.
