Heard learned counsel for the petitioners and learned Standing Counsel appearing on behalf of the State Respondents.
This petition has been filed with the following main prayers:-
"issue a writ of mandamus or a writ, order or direction in the nature of mandamus commanding the opposite parties to not to make any development in Panchkoshi Parikrama Marg in private lands without acquisition proceedings.
Issue a writ of mandamus or a writ, order or direction in the nature of mandamus commanding the opposite parties not to demolish and dispossess the petitioners from Gata No.1 without land acquisition proceedings.
Issue a writ or mandamus or a writ, order or direction in the nature of mandamus commanding the opposite parties to carry out the PanchKoshi Parikrama Marg, Ayodhya widening plan according to the site plan and revenue record.
Issue a writ of mandamus or a writ order or direction in the nature of mandamus commanding the opposite parties especially opposite party no.3 and 4 not to demolish old temples existing on old Abadi of Gata No.1 situated at Village MajhaBarhata, Tehsil- Sadar and District Ayodhya."
It is the case of the petitioners that respondents are proposing to construct a PanchKoshi Parikrama Marg in Ayodhya on Gata Nos.1, 2, 3, 4 and 8, which are bhumidhari land of the petitioners and they have built their houses thereon. The petitioners are also Mahants of various Mandirs . The deity of the Mandir is the perpetual owner of the property as settled with it under Section 9 of the U.P. Zamindari Abolition and Land Reforms Act.
No notification for land acquisition has been issued, yet the petitioners' houses/ Mandirs are being demolished.
Learned Standing Counsel shall seek instructions in the matter.
