The present petition has been filed seeking to assail an order dated 21.02.2024 passed by the respondent no.3/Sub Divisional Officer, Tehsil Sadar, District Varanasi in Case No. 13444/2020 (computerized case no. T202014799113444), Shiv Kumari Devi vs. Sachchidanand and others, under Section 116 of the U.P. Revenue Code, 2006, on the ground that the petitioner had not been granted adequate opportunity to file objections to the report dated 15.02.2022 submitted by the Nayab Tehsildar.
A further prayer has been made to issue a direction to the concerned respondent-authority not to pass a final order without granting adequate opportunity to the petitioner to submit his objections.
Counsel for the State-respondents submits that pursuant to the previous order, instructions dated 20.09.2024 have been received from the respondent no.3 indicating therein that on 18.09.2024 the
parties have appeared before the concerned respondent-authority and filed their objections to the "Kurra report", and thereafter the parties have been heard on 23.09.2024, and orders have been reserved.
It is submitted that efforts are being made for an early disposal of the case and that an endeavour would be made to conclude the proceedings within a period of one month from date.
Counsel for the petitioners though not disputing the aforestated stand taken by the State-respondents, seeks an expeditious disposal of the pending proceedings.
Having regard to the aforesaid, the present petition is disposed of with an observation that the court/authority concerned would make an endeavor to conclude the proceedings of the case, stated to be pending before it, preferably within a period of one month , provided there is no other legal impediment.
