We have perused the order dated 18.3.2024 passed by the office of the RBI Ombudsman. Relevant portion of the order is quoted below:-

ररिजरर रबक एककीककत लहोकपयल यहोजनय, 2021 (आरिरब-आईओएस) कके तहत INDIAN BANK कके वविरूद्ध वदनयनांक 15.01.2024 ककी आपककी वशिकययत-N202324011032595

भयरितबय ररिजरर रबक ककी ओरि सके शिशुभकयमनयएनां।

उपयशुरक्त वशिकययत ककी हमनके सयविधयनब पपूविरक जयनांच ककी हहै औरि इस स न ांरनांध मम हमयरिब वटिप्पवणिययय वनम्नयनशुसयरि प्रस्तशुत हहै।

The complainant alleges delay in release of security documents 2. The matter was taken up with the bank that confirmed having informed the complainant to collect the documents and also paid a compensation of Rs 5000/- 3. No other relief was sought 4. The complaint is therefore closed as resolved.

उपयशुरक्त कहो ध्ययन मम रिखतम हहए , हमनके आपककी वशिकययत कहो ररिजरर रबक - एककीककत लहोकपयल यहोजनय, 2021 कके खनांड 14(9)(a) कके तहत रनांद करि वदयय हहै।(1)

Upon perusal of the order, we find that the said order is not in the line with the RBI circular. Paras 6 to 8 of the circular dated 13.9.2023 is quoted below:-

"6. In case of delay in releasing of original movable / immovable property documents or falling to file charge satisfaction form with relevant registry beyond 30 days after full repayment/settlement of loan, the RE shall communicate to the borrower reasons for such delay. In case where the delay is attributable to the RE, it shall compensate the borrower at the rate of Rs 5,000/- for each day of delay.

In case of loss/damage original movable/immovable property documents, either in part or in full, the REs shall assist the borrower in obtaining duplicate/certified copies of the movable/immovable property documents and shall bear the associated costs, in addition to paying compensation as indicated at paragraph 6 above. However, in such cases, an additional time of 30 days will be available to the REs to complete this procedure and the delayed period penalty will be calculated thereafter ( i.e, after a total period of 60 days).

The compensation provided under these directions shall be without prejudice to the rights of a borrower to get any other compensation as per any applicable law"

In light of the same, we quash and set aside the impugned order dated 18.3.2024 with a direction to the RBI Ombudsman to pass a fresh and reasoned order upon the application made by the petitioner for payment of compensation for delay in providing the document and for the loss of the first page of the document. Personal hearing should be granted to the petitioner. This entire process should be completed within a period of twelve weeks from the date of presentation of certified copy of this order before the authority concerned.

With the above observations/ directions, this writ petition is finally disposed of.
