Heard Sri Om Shiv, learned counsel for the petitioner and learned Standing Counsel for the respondent-State.

The petitioner has preferred the present writ petition inter-alia with the following prayer:-

" I. Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to fix the grade pay of the petitioner as 4600 in place of 4200 w.e.f. 12-06-2015 and to pay the petitioner the difference of salary for the period with effect from 12-06-2015 to 30-11-2018 along with upto date interest expeditiously within the period stipulated period by this Hon'ble Court.

II. Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to revise the pension, amount of gratuity, amount of leave encashment and others benefits and to pay the petitioner the arrears of the aforesaid benefits. "

It is argued by learned counsel for the petitioner that petitioner is entitled for the aforesaid relief pursuant to the order passed by this Court dated 20.02.2003 in Civil Misc. Writ Petition No.10768 of 2001. It is further argued that while working on the post of Class-III employee namely Senior Assistant petitioner superannuated on 30.11.2018. Though the petitioner became entitled for the payment of his salary in the Grade Pay of Rs.4600/but wholly illegally he was paid the Grade Pay of Rs.4200/- w.e.f. 12.06.2015 till his retirement namely 30.11.2018. After his retirement petitioner also placed on record the letter dated 29.11.2018 written by the respondent no.2-Joint Director of Education, Kanpur Region, Kanpur to the respondent no.3-District Inspector of Schools, Farrukhabad by which he was directed to enquire the claim of the petitioner and submit his explanation. Since no decision was taken hence representations were made by the petitioner before the authority concerned from time to time,

thereafter again Joint Director of Education, Kanpur Region, Kanpur/respondent no.2 wrote a letter to the District Inspector of Schools/respondent no.3 on 24.08.2022. Inspite of the same, till date no decision has been taken in the matter.

On the other hand it is argued by learned Standing Counsel that the authority concerned will take a decision in the matter expeditiously.

With the consent of learned counsel for the parties, the writ petition is being disposed of at the admission stage itself.

In the facts and circumstances, petitioner is permitted to submit a fresh representation ventilating all his grievances before the respondent no.3 annexing copy of all the relevant papers and documents including copies of the letters written by the respondent no.2 to respondent no.3 namely letters dated 29.11.2018 & 24.08.2022 along-with certified copy of this order within a period of three weeks from today. If such a representation is made, the respondent no.3 is directed to pass appropriate order in accordance with law within a further period of three months.

With the aforesaid observations, present writ petition is disposed of finally.
