1. The petitioner has preferred the present writ petition inter-alia with the prayer to consider the compassionate appointment of the petitioner on the post of Assistant Teacher under dying in harness and also release the terminal service benefits of husband of the petitioner in favour of the petitioner.

Today when the matter is taken up, Shri Shashi Prakash Singh, learned counsel appearing on behalf of respondent nos. 1 and 2 placed before this Court instructions received under the signature of District Basic Education Officer, Azamgarh dated 18.07.2024, the same is taken on record. Copy of the same has also been provided to the counsel for the petitioner.

3 . It is stated in the aforesaid instructions that arrears of payment of the husband of the petitioner has already been paid to the petitioner vide orders dated 20.06.2024 and 29.06.2024 and the receipt of the same has been appended along-with the instructions.

Insofar as the appointment of the petitioner on compassionate ground is concerned, learned counsel for the respondents is placed reliance upon the instructions dated 04.05.2024 which is already on record and after going through the same it appears that the application for the appointment of the petitioner on compassionate ground has been rejected by the District Basic Education Officer, Azamgarh vide order dated 02.05.2024 on the ground that the educational qualification of the petitioner i.e., B.Ed is not sufficient for selection to the post of Assistant Teacher in primary school and directing the petitioner to submit her consent in case she is willing to receive the same as Class-IV employee.

5. In this view of the matter, the Court is of the opinion that both the reliefs as has been sought by the petitioner has already been granted to her, therefore, no further orders are required to be

passed.

6 . Accordingly, the writ petition is dismissed as having become infructuous .

7. Needless to say, in case the petitioner is still aggrieved against the offer of appointment as Class-IV employee, she will approach the appropriate forum as available in law.
