Shri Tanuj Shahi, learned counsel for the petitioner is directed to implead district in the array of parties during the course of the day.

Heard Shri Tanuj Shahi, learned counsel for the petitioner and learned Sanding Counsel for the State.

The petitioner claims that he is working as Incharge Head Master/Principal in the school and he is entitled to salary of the said post. A representation in this regard has been made to the competent authority which has not been decided till date. Learned counsel for the petitioners has placed reliance upon the judgment rendered by this Court in Smt. Raj Kishori Kushwaha Vs. State of U.P. and 5 others, Writ A No. 3863 of 2018 .

The only prayer made by learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time.

Learned Standing Counsel submits that the matter requires factual determination as per applicable law by the

competent authority in the first instance. However, he fairly contends that his claim for regular salary is liable to be decided by the competent authority within a reasonable time frame.

In wake of the preceding discussion and without going into the merits of the case, the District Basic Education Officer, Jalaun is directed to decide the representation of the petitioner regarding his claim for regular salary of Headmaster/Principal within a period of three months from the date of receipt of a certified copy of this order alongwith a fresh copy of the representation.

With the aforesaid direction, the writ petition is finally disposed of.
