Heard Sri D.K. Singh Chauhan, learned counsel for the petitioner as well as learned Standing Counsel for the respondents.

It has been submitted by learned counsel for the petitioner that the petitioner took voluntary retirement from service on 31.03.2024 from the post of Consolidator, District - Budaun. It is submitted that petitioner's services were confirmed on the post of Consolidation Lekhpal on 29.09.1998 with effect from 19.08.1991. Due to medical problems it was difficult for the petitioner to continue in service and consequently he had moved an application for Voluntary Retirement which was allowed and he has been permitted to retire from service with effect from 31.03.2024.

Grievance raised by the petitioner in the present writ petition is with regard to non payment of his post retiral dues and accordingly, prayer has been made for direction to the respondents to release of his pension and gratuity.

Learned Standing Counsel on the basis of written instructions received from Settlement Officer (Consolidation), Budaun has informed this Court that matter pertaining to release of post retiral dues of petitioner is under active consideration of the competent authority and decision in this regard is likely to be taken shortly and once decision is taken then all the admissible post retiral dues of the petitioner shall be paid immediately thereafter.

In the light of instructions received from respondent no. 5 Settlement Officer (Consolidation), Budaun, liberty is granted to the petitioner to move fresh representation before respondent no. 2 for release of his post retiral dues within next two weeks. In case any such representation is moved by the petitioner within the prescribed period, respondent no. 2 - Consolidation

Commissioner, U.P., Lucknow is directed to consider and pass necessary orders thereupon expeditiously, say within six weeks from the date of receipt of representation, in accordance with law and communicate the decision to the petitioner.

In case petitioner is found to be entitled for admissible post retiral dues, same shall be paid to him expeditiously, say within four weeks from the date decision is taken on petitioner's representation.

With above directions the writ petition stands disposed of .
